PROPERTY FACTS/DESCRIPTION: The applicant's 34,538 square foot parcel has 178.64 feet along Calves Neck Road and 119.60 feet along Midfarm Road. February 8, 2007 survey prepared by John T. Metzger shows the property is improved with a two-story, one-family dwelling. BASIS OF APPLICATION: Request for a Variance under Section 280-15, based on the applicant's request for a building permit to construct an accessory swimming pool, and the Building Inspector's March 9, 2007 Notice of Disapproval for the reason the pool is not permitted in a front or side yard, and the code requirement is for a rear yard location. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 5, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 26, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The owner/applicant proposes to construct a 36' x 16' accessory swimming pool in the southerly front yard and partly within the easterly side yard. AMENDED REQUEST: During the April 26, 2007 hearing, the applicant was requested to provided a modification to show a pool location closer to the house, instead of the 10 ft. setback from the easterly side yard that was requested when originally filed. During the second hearing held on April 26, 2007, the applicant submitted a diagram modified to show a minimum 13 ft. setback from the Page 2— May 10,2007 • ZB File No. 6023-Lenny and RanDaddona CTM No. 63-7-25 easterly side line, a pool filter and pump built with a 4" deadening section to reduce noise levels, evergreen bushes screening the south side of the proposed fence. The applicant also confirmed the pool will have a Sta-Rite Mod-Free System which requires no backwashing. The returns of the pool will be on the tree (south) side and the skimmers on the house (west) side. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is 34,583 square feet, with two front yards and two side yards. While there is no defined rear yard under the code provisions for a lot having this type of road frontage, there is ample room for the proposed accessory pool. The pool will not be visible to adjoining neighbors in the proposed location, which will also allow the owners to maintain mature existing trees and landscaping. The application indicates a 4' high enclosing fence with self-closing and self latching gate surrounding the proposed pool, as per code. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the property has two front yards, one along Calves Neck Road, and the other along Midfarm Road. Therefore, no rear yard as per code that exists in which to locate a pool. 3. The variance granted herein is not substantial. The proposed setback from Midfarm Road is 74 feet; and from Calves Neck Road is 80 feet. The proposed side yard setback is 13 feet. 4. The difficulty has not been self-created. There is no place to locate the proposed swimming pool without requesting relief. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is flat and is not near wetland or other environmental constraints. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to DENY the relief as applied for, and to GRANT the following Alternative Relief as shown on the survey prepared by John T. Metzger dated 2/8/07 and modified with a ZBA date of April 26, 2007 An easterly side yard setback at 13 feet as shown on the survey by John Metzger dated Feb. 8, 2007 and modifications hand-written, dated April 26, 2007 by the ZBA as submitted at a public hearing, subject to the following conditions: Page 3— May 10,2007 • ZB File No. 6023- Lenny and Ran addona CTM No.63-7-25 1. The pool shall meet all drainage codes for backwater discharge. Applicant states the pool will have a Sta-Rite Mod Free system that will require no backwashing. The returns will be on the tree side (south) of the pool and the skimmers on the west side near the house. 2. The pool filter and pump equipment shall be soundproofed. Applicant states that a 4' x 6' concrete pad with a 4" deadening layer shall be used for this purpose 3. A vegetative buffer of evergreens shall be planted to the south of the pool and continuously maintained to screen the pool from view from Midfarm Road. That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. PROPERTY FACTS/DESCRIPTION: The applicant's 34,538 square foot parcel has 178.64 feet along Calves Neck Road and 119.60 feet along Midfarm Road. February 8, 2007 survey prepared by John T. Metzger shows the property is improved with a two-story, one-family dwelling. BASIS OF APPLICATION: Request for a Variance under Section 280-15, based on the applicant's request for a building permit to construct an accessory swimming pool, and the Building Inspector's March 9, 2007 Notice of Disapproval for the reason the pool is not permitted in a front or side yard, and the code requirement is for a rear yard location. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 5, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 26, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The owner/applicant proposes to construct a 36' x 16' accessory swimming pool in the southerly front yard and partly within the easterly side yard. AMENDED REQUEST: During the April 26, 2007 hearing, the applicant was requested to provided a modification to show a pool location closer to the house, instead of the 10 ft. setback from the easterly side yard that was requested when originally filed. During the second hearing held on April 26, 2007, the applicant submitted a diagram modified to show a minimum 13 ft. setback from the Page 2— May 10,2007 ZB File No. 6023-Lenny and Randee Daddona CTM No. 63-7-25 easterly side line, a pool filter and pump built with a 4" deadening section to reduce noise levels, evergreen bushes screening the south side of the proposed fence. The applicant also confirmed the pool will have a Sta-Rite Mod-Free System which requires no backwashing. The returns of the pool will be on the tree (south) side and the skimmers on the house (west) side. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is 34,583 square feet, with two front yards and two side yards. While there is no defined rear yard under the code provisions for a lot having this type of road frontage, there is ample room for the proposed accessory pool. The pool will not be visible to adjoining neighbors in the proposed location, which will also allow the owners to maintain mature existing trees and landscaping. The application indicates a 4' high enclosing fence with self-closing and self latching gate surrounding the proposed pool, as per code. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the property has two front yards, one along Calves Neck Road, and the other along Midfarm Road. Therefore, no rear yard as'per code that exists in which to locate a pool. 3. The variance granted herein is not substantial. The proposed setback from Midfarm Road is 74 feet; and from Calves Neck Road is 80 feet. The proposed side yard setback is 13 feet. 4. The difficulty has not been self-created. There is no place to locate the proposed swimming pool without requesting relief. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is flat and is not near wetland or other environmental constraints. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to DENY the relief as applied for, and to GRANT the following Alternative Relief as shown on the survey prepared by John T.
