PROPERTY FACTS/DESCRIPTION: The applicants' 31,518 square foot non-conforming parcel in an R- 40 Zone with 206.84' along Lighthouse Road, is improved with single family dwelling as shown on 4/6/2004 survey, revised January 22, 2007, by John Metzger (Peconic Surveyors, P.C.) BASIS OF APPLICATION: Request for a Variance under Section 280-124 based on the Building Inspector's February 15, 2007 Notice of Disapproval concerning an "as built" deck addition with a rear yard setback of 45.5 feet instead of the code-required 50 feet. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 5, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 26, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The owner/applicant requests a reduction from the code requirement of 50 feet to allow the as built raised deck addition at the rear of the dwelling, shown at 45.5 feet from the rear lot line on the January 22, 2007 revised survey by Peconic Surveyors, P.C. PENDING BUILDING PERMIT: A new dwelling with a rear deck was applied for under Building Permit No. 32427-Z dated October 13, 2006 (replacing Permit No. 30631-Z). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 'Page-2-May 10,2007 ZB File No. 6019-John and Vivi nemoyanis CTMZ.lo.50-4-2.2 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The northerly corner of the deck was modified to try to correct the as-built nonconformity that was created under construction. As a result, the angled corner of the deck as modified conforms to the 50 ft. code requirement , however the closest corner is 45.5 feet, for a very section with steps within the restricted 50 ft. setback area. The lot is irregularly shaped and a row of evergreens along the entire perimeter has been recently planted to screen the entire rear yard from views by neighboring properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance since their new house and deck were recently built and removing the set of stairs in question and building a new set in a code compliant location would create financial burden and inconvenience. 3. The variance granted herein is not substantial. The as built deck is 35' 10" long x 16' deep and has a code compliant setback. Only the stairs attached to the deck at the north end where they jut beyond the required 50' setback requires a variance of 4'5", or relief of 9%. 4. The alleged difficulty has not been self-created but was the result of unintentional error by the owner/applicant's builder/contractor. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a raised deck with stairs while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 4/6/2004survey, revised January 22, 2007 by Peconic Surveyors, P.C. and construction diagram modified by the applicants with ZBA date stamp of March 2, 2007. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. PROPERTY FACTS/DESCRIPTION: The applicants' 31,518 square foot non-conforming parcel in an R- 40 Zone with 206.84' along Lighthouse Road, is improved with single family dwelling as shown on 4/6/2004 survey, revised January 22, 2007, by John Metzger (Peconic Surveyors, P.C.) BASIS OF APPLICATION: Request for a Variance under Section 280-124 based on the Building Inspector's February 15, 2007 Notice of Disapproval concerning an "as built" deck addition with a rear yard setback of 45.5 feet instead of the code-required 50 feet. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 5, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 26, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The owner/applicant requests a reduction from the code requirement of 50 feet to allow the as built raised deck addition at the rear of the dwelling, shown.at 45.5 feet from the rear lot line on the January 22, 2007 revised survey by Peconic Surveyors, P.C. PENDING BUILDING PERMIT: A new dwelling with a rear deck was applied for under Building Permit No. 32427-Z dated October 13, 2006 (replacing Permit No. 30631-Z). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—May 10,2007 ZB File No. 6019-John and Vivian Hnemoyanis CTM No.50-4-2.2 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The northerly corner of the deck was modified to try to correct the as-built nonconformity that was created under construction. As a result, the angled corner of the deck as modified conforms to the 50 ft. code requirement , however the closest corner is 45.5 feet, for a very section with steps within the restricted 50 ft. setback area. The lot is irregularly shaped and.a row of evergreens along the entire perimeter has been recently planted to screen the entire rear yard from views by neighboring properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance since their new house and deck were recently built and removing the set of stairs in question and building a new set in a code compliant location would create financial burden and inconvenience. 3. The variance granted herein is not substantial. The as built deck is 35' 10" long x 16' deep and has a code compliant setback. Only the stairs attached to the deck at the north end where they jut beyond the required 50' setback requires a variance of 4'5", or relief of 9%. 4. The alleged difficulty has not been self-created but was the result of unintentional error by the owner/applicant's builder/contractor. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a raised deck with stairs while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 4/6/2004survey, revised January 22, 2007 by Peconic Surveyors, P.C. and construction diagram modified by the applicants with ZBA date stamp of March 2, 2007. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
