WITNESSETlt, that thc party of the first part, in consideration ofTen Dollam and other valuable
consideration paid by the party ofthe second part, does he.reby grant and release unto the party of
the second part. the heirs or successors and assigns of the party of the second par~ forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
e-meted, situate, lying and being at Bayview, in the Town of Southold, County of Suffolk and
Slate of New York, knoss~ and designated as and by part of lot number 29 and pan of lot number
30 on a certain map entitled. "Map of Leeward Acres at Bayview," filed in the Office of thc
Clerk of the Count)' of Suffulk on June 4, 1971 as Map No. 5599 and being more particularly
bounded as Follows:
BEGINNING at a point on the southwesterly side of Leeward Drive distant the following two
courses and distances from the extreme easterly terminus of a curve, which curve connects the
southwesterly side of Leeward Drive with the easterly side of .Iacob's Lane:
South 61 degrees 23 minutes 30 seconds Eest, 372.09 feet;
South 54 degrees 43 minutes 50 seconds East, 16 feet to the point ofbeginning.
RUNNING THENCE from the point of beginning along the southwesterly side of Leeward
Drive, South 54 degrees 43 minutes 50 seconds Fast, 200 feet;
RUNNING THENCE South 35 dcgrecs 00 minutes 30 seconds West, 209.47 feet;
RUNNING THENCE North 54 degrees 43 minutes 50 seconds West, 184.50 feet;
RUNNING THENCE North 30 degrees 46 minutes 40 seconds East, 210.11 feet to the
southwesterly side of Leeward Drive, the point or place of BEGINNING.
TOGETHER with an undivided one fifty-third, (1/53~.) interest in lands shown and designated as
"Park,. Recreation and Drainage Area" on the Map of Leeward Acres at Bayview, filed in the
Office of the Clerk of the County of Suflblk on June 4, 1971 as Map No. 5599.
BEING AND INTENDED TO BE the same premises conveyed to the pany of thc first part by
deed dated December 6, 1999, and recorded December 9, 1999, in thc Off]cc of the Suffolk
County Clerk in Libor 12006, Page 148.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises: TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns oftbe party of the second part forever.
AND the party of tho Ilrst part covenants that the pany of the first part has not done or suffered
anything whereby the said premises have been encumbered in any wa}, whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of thc Lien Law, covenants that
the party of the first pan will receive the consideration for this conveyance and will hold the right
m receive such consideration as a trust fund to be applied first tbr the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any pan of the total of the same for any other purpose.
The word "party" shall be construed as if it read "panics" whenever the sense ofthis indenture so
requires.
