WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the

authority given in and by said last will and testament, and in consideration of

dated July 9, i 955 and r~corded in ~he'Suffolk County Clerk's Office on July 12, 1955 at Liher 3926
of Deeds at Pagn 101; ALSO shown and tiesignaled on a survey made by Otto Van Tuyl 8: Son,
dali July 2, 1954 as parcel//7, a cop~ of which survey is annexed to and forms a pan ora certain
Declaration dated the 23'~ of April. 1955, and recorded in Suffolk County Clerk's office in Liher 3892
of Deeds at Page 202 - 210, which survey is designateti in said Declaration as Exhibit A.
TOGETHER with the right to use in common with others those lands designated on the aforeseid
survey as "Reservation A", and the rights-of-way likewise designated thereon.
TOGETHER with an undivided I/7 interest in the lands designated on thc aforesaid survey as
"Reservation A".
Subject to the fights ofthe owners of parcels 1,2,3,4,5 and 6 as designated on the aforesaid sttrvey,
and their invitees to use the lands designated as "Reservation A' as a private beach for bathing,
sunbathing, picnickin~ and related uses, and to the rights of said owners to use the fight-of-wey
likewise designated thereon.
SUBJECT to lhe provisions of the aforesaid Declaration dated 23'~ of April, 1955 and recorded in
the Suffolk Coun .fy Clerk's office in Liher 3892 of Deeds at Page 202 - 210.
TOGETHER with all fish~, title and interest, ifany, of the party of the first part of, in and to any
streets and roads abutting the above-deseribed premises to the center lines thereof,
TOGETHER with thc appurtenances, and also ali the estate therein, which the party of the first part
has or has power to convey or dispose of, whether individually, or by virtue of said will or other~4se.
TO HAVE AND TO HOLD the premises her~in granted unto the part)' ofthe second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first pazt covenants that the party of the first part has not done or suffered
anything whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Licn Law, covenants that the
party of the first part will receive the consideration for this conveyance and will bold the right to
receive such consideration as a trust fund to he applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment ofthe cost ofthe improvement before using
any ir, m of'the total of the same for any other purpose. Thc word "party" shall be construed ns ifit
read "parties" whenever the sense of this indenture so requires.
