WITNESSETH, that the para,! of the first part, to whom letters testamentary wore issued by the Surmpate's Court,
County of Suffolk, State of New York on April 30, 1998, and by virtue of the power and authority glvan in and by
said last will and t _,~3~_mant, and/or by Article 11 of the Estates, Powers and Trusts Law, and In consideration of
zero dollars, this conveyance being made pursuant to the terms of said last will and testament of Dorothy M.
Dawson, surviving tenant by the entirety of Albert D. Dawson, does hereby grant and release uno the party of
the second part, the distdbutees or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and Improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being moro particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same'premises conveyed to the said Albert D. Dawson and the said Dorothy
M. Dawson by deed, dated August 21, 1950 and rocorded In the Office of the Suffolk ~,ounty Clerk on April 13,
1953 In Uber 3499 page 596, the said Albert D. Dawson having predeceased the said Dorothy M. Dawson while
still marfledtothesald Dorothy M. Dawson.~ said pram/see being Increased by the addition of
parcels acquired by deed dated February 23, 195.5 and recorded tn such Offlce on
April 13, 1955 in Liber 3868 page 119 and by deed dated September 22~ 1980 and
recorded on September 29, 1980 in Ltbsr 8888 page 509.
TOGETHER with all rtght, title and Interest, If any, of the party of the first part, In and to any streets mxJ roads
abut~ng the above dascrJbed premises to the center lines thereof; TOG ETHER with the appurtenances, and =_Leo
all the estate which the seld decedent had at the time of decedents death In said promises, and also the estate
theroin, which am pmty of the first part has or has power to convey or dispose of, whether individually, or by virbJe
of said will or othem4se; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the paW oftha first part has not done or suffered anything whereby
the said promlsas have been enctm~erod In any way whatever, excep~ as aforesaid.
AND the party of the first part, In compliance with Section 13 of the Men Law, covenants that the party of the first
p;ut will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied lirst for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the Improvement beforo using any part of the total of the same for any other
propose. The word 'party' shall be construed as If It road 'parties" whanever the sense of this Indenture so

All that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Fishers Island, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a stone monument on the nodheasterly line of Montauk Avenue, which
monument is located 2354.35 feet North of a point which is 1077.80 feet West of another
monument marking the United States Coast and Geodetic Survey Triangulation Station
"PROS'; and
RUNNING THENCE along the northeasterly line of Montauk Avenue North 27 degrees 36
minutes 20 seconds West, 121.50 feet to a monument;
THENCE still along the northeasterly line of Montauk Avenue North 48 degrees 09 minutes 40
seconds West through a monument, 60.63 feet to a monument;
THENCE still along the northeasterly line of Montauk Avenue North 55 degrees 46 minutes 30
seconds West, 58.93 feet to a monument on the northerly line of Montauk Avenue;
THENCE along the northerly line of Montauk Avenue North 71 degrees 41 minutes 50
seconds West, 110.76 feet to a merestone on the easterly line of land now or formedy of
Union Free School District No. 4, which merestone is located 2572.22 feet North oft point
which is 1332.53 feet West of .~aid 'PROS" monument;
THENCE North 41 degrees 16 minutes 15 seconds East, 175.94 feet to a point;
THENCE North 06 degrees 34 minutes 30 seconds East, 113.97 feet to a point;
THENCE North 70 degrees 47 minutes 40 seconds West, 75.0 feet to a point;
THENCE North 71 degrees 49 minutes 20 seconds East, 174 feet, more or less, to the high
water line of West Harbor (formerly known as Great Harbor);
THENCE along the high water line of West Harbor in a general southerly direction, 100 feet,
more or less, to a point;
THENCE still along the high water line of West Harbor South 41 degrees 16 minutes 15
seconds West, 15 feet, more or less, to a monument, which monument is located 2794.65 feet
North of a point which is 1137.32 feet West of said 'PROS' monument;
THENCE still along the high water line of West Harbor in a general southeasterly and
southerly direction, 418 feet, more or less, to a point;
THENCE South 37 degrees 36 minutes 20 seconds West through a monument. 111.58 feet to
the monument on the northeasterly line of Montauk Avenue at the point or place of
BEGINNING.
TOGETHER with all the right, title and interest of the party of the first part in and to the sea
wall which runs along or near the Harbor side of said premises, the land on which the sea wall
is constructed and erected, any land between the sea wall and the shore line of West Harbor,
any accretion to the upland, and the land in the bed of Montauk Avenue in front of, adjacent
to, contiguous to or abutting on said premises.
TOGETHER with all the rights of the party of the first part as riparian owner and all the rights,
licenses, privileges, hereditaments and appurtenances thereunto belonging or in any wise
appurtenant.
