Dear Mr. Koehler:
The Southold Town Planning Board, at a meeting held on Monday, June 12, 2006,
adopted the following resolutions:
The final public hearing was closed.
WHEREAS, the amended site plan is for the proposed alteration and expansion of an
existing 1,357 sq. ft. building and approved conservatory building and dormer of 1,995
sq. ft. to include a 1,462 sq. ft. addition which includes a site plan change in parking to
41 required spaces and 59 overflow spaces provided on 4.46 acres in the AC Zone
located on the n/s/o New York State Road 25 and 1,506' e/o Peconic Lane known as
44075 Main Road in Peconic. SCTM#(s) 1000-75-1-20.1 & 20.2; and
WHEREAS, Frederick W. Koehler is the owner of the property located on the e/o
Peconic Lane known as 44075 Main Road in Peconic; and
WHEREAS, on August 9, 2005, the Southold Town Planning Board granted final
approval on the site plan prepared by J. Grammas Consulting and certified by Carlos E.
Cala, Registered Architect, dated December 17, 2003 and last revised August 31,2004
and authorized the Chairperson to endorse the final site plans, and the requirements of
that site plan remaining effect, except as modified herein: and
WHEREAS, on February 14, 2006, the applicant, Frederick W. Koehler, submitted an
amended formal site plan for approval; and

WHEREAS, on February 16, 2006, the Suffolk County Department of Health Services,
Reference No. C10-04-012, approved the revised plans to include the 1,462 square foot
addition from their original approval on July 12, 2005; and
WHEREAS, on March 1, 2006, the Architectural Review Committee reviewed the
architectural drawings and associated site plan materials and approved the project
pending submission of proposed lighting and catalog cuts; and
WHEREAS, on March 24, 2006, the New York State Department of Environmental
Conservation responded that a permit is not necessary as long as all work is outside of
any tidal or freshwater wetlands boundary; and
WHEREAS, on April 3, 2006 the Planning Board accepted the "Landscape
Development Planting Plan" dated March 24, 2006 and supporting materials prepared
by Richard W. Gibney, R.L.A. including the removal of a 40" caliper sycamore maple
located on the south side of the property east of the existing driveway entrance and
replacing it with three (3) 2 - 2.5" caliper red maples; and
WHEREAS, on April 5, 2006, the owner and President of Osprey Dominion Vineyards,
Frederick W. Koehler, submitted a formal request to withdraw the windmill application
known as LIPA Windturbine; and
WHEREAS, on April 6, 2006, the Suffolk County Department of Planning responded to
the applicant's request stating the proposed expansion is not on property in which the
County owns development rights and has no objection to the proposed expansion; and
WHEREAS, on April 17, 2006, the Southold Fire District responded that adequate fire
protection has been supplied; and
WHEREAS, on April 20, 2006, the Southold Town Building Inspector reviewed and
certified the amended site plan for a "winery" use; and
WHEREAS, on May 1,2006, the New York State Department of Transportation
responded after review and determined a Highway Work Permit is not required "as long
as all work is progressed outside the Route 25 highway ROW and the Route 25
highway ROW is not used to perform any work"; and
WHEREAS, on May 4, 2006, the Architectural Review Committee reviewed the
proposed lighting and catalog cuts and approved the project; and
WHEREAS, on May 8, 2006, the Southold Town Engineer reviewed the amended site
plan materials and replied that all items have been addressed in a satisfactory manner;
and

WHEREAS, on June 9, 2006, the Suffolk County Department of Planning responded
after review and determined this matter is for "local determination as there appears to
be no significant county-wide or inter-community impact(s),' and the Planning Board
accepts this pursuant to 239L & M General Municipal Law; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, the following items shall be required:
All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries. The lighting must meet town code requirements.
If necessary, the applicant must obtain a SPDES General Permit (NYR-10Ho57)
for Storm Water Discharges (General Permit Number GP-02-01) from the New
York State Department of Environmental Conservation for the construction
activities.
3. All signs shall meet Southold Town Zoning Codes and shall be subject to
approval of the Southold Town Building Inspector.
4. As per the landscape survivability guarantee, the applicant agrees to replace any
of the landscaping which dies within three (3) years of planting; be it therefore
RESOLVED, that on April 5, 2006, the owner and President of Osprey Dominion
Vineyards, Frederick W. Koehler, formally withdrew the windmill application known as
LIPA Windturbine pursuant to Southold Town Code §100-254 B (6); be it further
RESOLVED, that on April 11,2006, the Southold Town Planning Board, acting under
the State Environmental Quality Review Act (6 NYCRR), Part 617.5 c (7), makes a
determination that the proposed action is a Type II and not subject to review; and be it
further
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action
under the policies of the Town of Southold Local Waterfront Revitalization Program and
has determined that the action is consistent provided that the best management
practices outlined in the June 5, 2006 memo prepared by the LWRP Coordinator are
implemented; and be it further
RESOLVED, that pursuant to Southold Town Code 100-254 Part I, the applicant agrees
to incorporate all the requirements, comments, and recommendations of each reviewing
agency as referenced above and as indicated on the site plan and corresponding
attachments; and be it further

RESOLVED, that the Southold Town Planning Board grant approval on the amended
site plan prepared by Carlos E. Cala of J. Grammas Consultants dated December 17,
2003 and last revised April 24, 2006 and the Landscape Development Planting Plan
prepared by Richard W. Gibney dated March 24, 2006 and authorize the Chairperson to
endorse the site plans with the following conditions:
1. The site plan approval requires that all work proposed on the site plan shall be
completed within three (3) years from the date of this resolution.
Prior to the request for the Certificate of Occupancy, the owner or authorized
agent must request the said Building Inspector and the Planning Board to
perform an on-site inspection to find the site improvements are in conformity with
the approved amended site plan.
If the as-built site improvements vary from the approved amended site plan, the
Planning Board reserves the right to request a certified as-built site plan detailing
all the changes.
Any changes from the approved amended site plan shall require Planning Board
approval, and any such changes without Planning Board approval will be subject
to referral to the Town Attorney's Office for possible legal action.
The Planning Board will issue a final site plan approval in the form of a letter following a
site inspection and at the time the site improvements are found to be in conformance
with the approved site plan. ,
A copy of the approved amended site plan is enclosed for your records. As per the
Town Code, one copy each will be distributed to the Building Department and Town
Engineer/Highway Department.

Dear Mr. Koehlen
At your written request date received March 7, 2007, Planning Department Staff performed a final ske inspection at
the above referenced property on the ske plan stamped approved June 13, 2006. In reference to the above, the
Planning Board held a work session on April 30, 2007 and May21, 2007 to discuss the approved ske plan prepared by
Carlos E. Cala dated December 17, 2003 and last revised April 24, 2006, the resolution dated June 13, 2006, the as-
built ske plan prepared by John A. Grammas dated December 17, 2003 and last revised April 26, 2007 and staff ske
risk comments regarding the above referenced ske plan.
The Planning Board has determined the ske plan requirements have been satisfied and include the following kems:
· All handicap parking stalls, access aisles and signage must comply with New York State Code and ADA
requirements.
· Outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and
roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare
within property boundaries. All lighting must meet town code requirements.
· As per landscape survivability, the applicant agrees to replace any of the landscaping which dies within three
(3) years of planting.
· As per Town Code $280-127, "any change in use or intensity of use which will affect the characteristics of the
site in terms of parking, loading, access, drainage, open space or utilities will require site plan approval".
· The Planning Board recognizes the existing flagpole on the property, not indicated on the as-built site plan.
This letter does not condone anychanges from the as-built site plan and approvals from other agencies if required.

Dear Mrs. Woodhouse:
As per a request from your office, I have reviewed the revised "as-built" site plan for the above
referenced project. The site plan has been prepared by J Grammas Consultants and has a revision
date (#6) of April 26, 2007.
The one significant change to the Site Plan is that the proposed turning circle at the entrance
to the facility has been significantly reduced in area. The Drainage Calculations have been amended
and the drainage design has been modified to adequately address this change.
At this time, all of the site improvements indicated on the "as-built" plan meets the minimum
requirements of Town Code. If you have any questions regarding this review, please contact my
office.

the turn around area in front of the existing tasting room as approved bythe Planning Board June 13, 2006.
In addition please be aware there is a flagpole on the property which is not shown on the as-built site plan;
this can be seen in the enclosed site visk photos. After a discussion with Tom Stevenson, Vineyard
Manager, today the final lift of asphalt (for the entire paved area) will be installed within the next few weeks.

Dear Ms. Woodhouse,
On Friday March 9th, we had a visit from Planning Board personel here at
Osprey's new tasting room. Following the visit, some suggestions were made for us to
address.
First, we will immediately "cold patch" around two manhole covers and the
handicap ramps in the parking lot to fix tripping hazards until our paving contractor can
put on the final coat of asphalt in April (or early May as weather allows). The signage
for the handicap sites will also be raised to 5' from 4'.
The "as built" site plan is being produced and will accurately reflect the
landscaping around the building (and behind the winery building), the parking lot layout
and roadway to the front of the tasting room (no turnaround was added). The
handicapped parking spots near the winery building have been moved slightly to the west
and closer to the new building. The "as built" site plan will contain revised drainage
calculations as necessary.
We would request that if the above is acceptable to the Planning Board, that the
Board sign off on the project before the weather-related items are completed.

The applicant proposes the akeration and expansion of an existing 1,357 sq. ft. building and
approved conservatory building and dormer of 1,995 sq. ft. to include a 1,462 sq. ft. addition
which includes a site plan change in parking to 41 required spaces and 59 overflow spaces
provided on 4.46 acres in the AC Zone located on the n/s/o New York State Road 25 and
1,506' e/o Peconic Lane known as 44075 Main Road in Peconic.
The proposed action has been reviewed to Chapter 95, Waterfront Comistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the infonmtion provided on the LWRP Consistency
Assessment Form submitted to this department as well as the records available to me, k is
my determination that the proposed action is generally CONSISTENT with the Policy
Standards and therefore is CONSISTENT with thc LWRP provided that the
following standard best management practices are implemented.
Pursuant to Chapter 95, the Planning Board shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
Policy 5. Protect and improve water quality and supply in the Town of Southold.
To further Policy 5, and protect and improve the water quality and supply in the area,
consider the following:
1. Encourage the use of appropriate grass varieties (es, sun tolerant vs. shade tolerant)
2. Require a three (3) year survival requirement for all planted vegetation.

If applicable, recommend the use of mulch materiak generated by the Town of
Southold Compost Facilityin order to contribute to the replenishment of o~anic
matter in local soils and help reduce the reliance of fertiliTers and herbicides and
minimize the reduction of fertilizers and herbicides in the Town's ground and
surface waters.
Require native and drought-tolerant plants in landscaping,
Recommend low flow toilets to conserve water usage when and if a structure is
constructed.

1. Drainage calculations have been amended and the drainage design has been
modified to adequately address the concerns in my last report, dated 4/3/06.
2. Note "B" was added to the drawing regarding the existing Sanitary Leaching Pool
system located under the proposed new pavement. All existing drainage castings will
be upgraded to traffic bearing capacity where needed or required. All Septic System
Tanks and Pools shall have a solid cast iron inspection covers to final grade or
pavement surface to meet the minimum requirements of the Suffolk County Health
Department.
With the exception of the items listed herein, all of the items listed in my last report have been
addressed in a satisfactory manner. If you have any questions regarding this review, please contact

In order to assess the impact of the proposed work and determine if the issuance of a New York
State Highway Work Permit is required, the following items shall be shown on the plans:

The plans shall call out and show the limits of driveway re-construction.
All driveway grades as well as existing and proposed drainage features shall be shown on
the plans. We are particularly interested in the site's internal drainage, since we do not
permit runoff from property onto the State highways. Drainage calculations shall be
provided to demonstrate that the drainage collection and containment system has
sufficient capacity for runoff generated on site.
It appears that utility work is being proposed. Any utility work proposed in State

At our work session on Monday, April 3, 2006, the Planning Board reviewed the above referenced
application. The Planning Board accepted the landscape development plan dated March 24, 2006 prepared
by Richard W. Gibney. The Planning Board also accepted the comments and recommendations of the
Town Engineer. A copy of that letter is attached for your reference. In addition to incorporating the Town
Engineer's comments into your plan, please be aware the following items must be addressed/completed
prior to site plan approval:
1. Detailed information showing ramp access, including elevations, from the ADA parking to the
entrance of the Conservatory.
2. A detailed drainage plan (see attached letter).
3. ApprOval from Suffolk County Land Acquisition regarding the proposed work as it abuts their
property.
4. A letter withdrawing the windmill application from this office.
5. Approval from New York State Department of Transportation.
6. Approval under the LWRP.
7. ARC approval for the proposed lighting and catalog cuts.
8. Town Engineer approval, incorporating all recommendations of attached letter.
9. Southold Fire Department approval.
10. Suffolk County Department of Planning approval.
Once all of the above kems have been addressed, certification may be obtained from the Building
Department and a public hearing can be set.

As per a request from your office, I have reviewed tbe:-revised..si[e plan for
referenced project. The s~te plan has been prepared by J Grammas Consultants ~fnd
date of March 9, 2006. Please consider the following:
1. Drainage calculations have been provided for the proposed building additions. Additional
drainage calculations will be required. These calculations shall include all New Asphalt Pavement,
Sidewalks or any other proposed hardened surface. Catch basins shall be located in such a manner
to prevent run-off from entering the State Right-of-Way. All new drainage pools should be numbered.
Grade elevations of the inlet castings should be provided and pavement slopes and/or grade
elevations should be noted to indicate adequate pitch in asphalt surfaces.
2. New pavement for the traffic circle has been indicated over an existing Sanitary Leaching Pool
system. An Engineers certification regarding traffic bearing capacity of the existing pools should be
provided. All leaching pools should have a solid cast iron inspection cover to final grade of pavement
and/or shall meet the minimum requirements of the Suffolk County Health Department.
3. Landscaping has been noted on the plan as "to be submitted under a separate application".
This item should be reviewed and approved by the Planning Board.

This is to acknowledge receipt of your submission on the above permit application. The re-
submitted plan shows considerable changes proposed within the existing driveway; however, the
plan does not show the proposed finished driveway profile. The driveway elevations shall be
shown on the plans in order for us to determine that all on site drainage is being contained on site
as we do not allow any runoff from private property onto the State highway.
The revised plans do not adequately show if any work (other than utility work) is proposed
within the New York State highway right-of-way (ROW). The plans must clearly show all
proposed work and / or proposed vehicle / equipment staging within the highway ROW. If no
work is proposed within the highway ROW the plans shall clearly state that.
We are in the process of reviewing your submission. When our review is complete we will notify
you by letter so you can provide further direction to the applicant in the Highway Work Permit
application process. Please do not submit revised plans until we have completed our review and
provided you with our review comments.
Any utility work proposed in State Highway right-of-way, which would include your proposed
water service connections, will require separate application and submission of plans (installation
details, restoration details and Maintenance and:Protection of Traffic plan - all referenced to
NYSDOT specification item numbers and the Manual of Uniform Traffic Control Devices) to
our Riverhead Maintenance facility. You may contact Mr. Kevin Matthaei at (631) 727-1731 for
further directions regarding Utility Highway Work Permit (HWP) applications. Please be
advised that utility HWP issuance is subject to issuance of the HWP required for site work.

This permit application should be sensitive to the unique visual and historic setting of the
Long Island North Shore Heritage Area, which runs from the Queens/Nassau County line to
Orient Point, and from Route 25 or I495, whichever is farther south, north to Long Island Sound.
In all future correspondence, please refer to the subject case number. The plans must also
include the County tax map number.

I am requesting the Town of Southold's per'to remove a ~ycamore maple tree'of
approximately 40' caliper (see altached photo). Please note the following.
· There are several limb failures in the crown.
· This tree has excessive intedor decay.
· A concrete filled cavity is located at the main trunk crotch where this tree is likely to fail in a
high wind situation.
· Proposed curb and entry ddve construction will cause root damage that further weakens this
tree.
· If either of the main trunks fail, there is a potential for sedous property damage and personal
injury due to the tree's location.
The owner has agreed to replace this tree with three new trees in the same general location. Our
plan will indicate size and species.
