Dear Town Board:
I am writing requesting a refund for Building Permit no. 28946 issued on November 26,
2002. Due a financial change in our life and the cost of building a house on Fishers
Island, we will not be building on the property any time soon. No work or construction has
taken place on our property. It is still vacant land. I do understand that there will probably
be some administration or processing fee associat~e~:l with our initial application requesting
the Building permit. This can be deducted fro~our application-filing fee of $1,195.80.

Re: Life Magazine Dream House
Dear Mr. Shillo,
After conducting a health safety and welfare review of the Life Magazine Dream House
designed by drawings Robert A.M. Stern, I have sealed them for your one time use limited to
Fishers Island as drawn and constructed by Z&S Contacting with you as a principal. Z&S
Contacting is responsible job oversight, site safety, and for building in compliance with all New
York State Codes and Town of Southold and Fishers Island regulations or whatever codes are
in effect at the time of the filing.
I have ascertained that the person furnishing the plans, Robert A.M. Stem, R.A. is of high
professional standing and has not violated any statutory restrictions on practice and under the
limited circumstances defined by Section 29.3a.3 of the Regents Rules.
This letter is to accompany any filing or my signature and stamp on the plans is null and void.
Plans have not been examined for compliance with Southold Zoning regulations. I assume no
liability for the plans.
I sign these plans on the condition that Z&S Contacting submits this letter with the filing and
incorporates the following changes into their work as they build:
Smoke Detectors: Provide smoke detectors outside, but in close proximity to, all
sleeping rooms in conformance with New York State Code 9B, which are not indicated
on the plans.
Boiler Room: The boiler room is too small for safe clearances from the walls. Walls of
the boiler room are to be % hour fire resistant minimum. A I s.f. fresh air inlet from the
exterior is required.
3. Chimney: No boiler chimney is shown on the plans. A code compliant chimney (either
masonry or double walled) is required to serve the boiler.
4. Oil/Propane Storage: An code compliant oil storage tank or propane tank enclosure
located at a code compliant distance remote from the boiler will be required.
5. Wind Resistance: Plans are not designed to resist wind loads. To adapt the plans to
local conditions, add Simpson Hurricane ties, sized according to the lumber, and
ialled as per manufacturer's instructions to hold down the roof and eaves.

Airspace: Plans do not show the required airspace. Plans show batt insulation
touching the interior walls and floors which is incorrect. Airspace should always be
toward the warm side (toward the habitable area). The reasons for this are:
a. Air is an insulator. Calculations of the R-value of the wall are based on the
assumption that the airspace is on the warm side.
b. If the vapor barrier touches the wood frame, rotting is likely because, without
Airspace, warm interior spaces will precipitate moisture on the cooler vapor
barrier and this moisture would soak into any matedal in contact.
Second I¥1eans of Egress: When the intemational code goes into effect which is
scheduled for this year, egress regulations will change. As currently pm posed, the
International Code requires 5.7 s.f. minimum clear opening as a second means of
egress from second floor habitable moms. This regulation would impact on Rooms
204, 205, 206 and 207 which now appear compliant under New York State Building
Code 9G which requires 4 s.f. minimum clear opening. If compliance with the
international code becomes necessary change the twin windows in the
aforementioned moms to one single wide window to meet the new standard.
Below please find the New York State Building Code 9G regulations in effect at the time of this
letter:
PART 714 - OPENINGS FOR EMERGENCY USE
<CI-420>
714.1 GENERAL REQUIREMENTS. <CI-525; CI-648>
714.1(a) In addition to the primary exit from a recreation room, or a habitable space except kitchens, there shall
be provided in each such space at least one opening for emergency use.
714.1(b) Openings for emergency use shall include doors or openable parts of windows, located so as to provide
unobstructed egress to legal open spaces. <C1-146, CI-753, Cl-673, CI-787>
714.1(c) Such openings shall not impede egress in an emergency, shall have a minimum area of four square
feet, with a minimum dimension of 18 inches, with bottom of openings no higher than 3 feet 6 inches above
finished floor in all above-grade stories, and no higher than 4 feet 6 inches where required in basement and
cellar. <C1-146>
Below please find the Intemational Building Code regulations to go into effect soon:
§1009
EMERGENCY ESCAPE AND RESCUE
§1009.1 General. In addition to the means of egress required by this chapter, provisions shall be made for
emergency escape and rescue in Group R as applicable in §101.2 and Group I-1 occupancies. Basements and
sleeping rooms below the fourth story shall have at least one exterior emergency escape and rescue opening in
accordance with this section. Such opening shall open directly into a public street, public alley, yard or court.
EXCEPTIONS:
1. In other than Group R-3 occupancies as applicable in §101.2, buildings equipped throughout with an
approved automatic sprinkler system in accordance with §903.3.1.1 or §903.3.1.2.
2. In other than Group R-3 occupancies as applicable in §101.2, sleeping rooms provided with a door to a fire-
resistance-rated corridor having access to two remote exits in opposite directions.

3. The emergency escape and rescue opening is permitted to open onto a balcony within an atrium in
accordance with the requirements of ~404 provided the balcony provides access to an exit and the dwelling unit
or sleeping room has a means of egress that is not open to the atrium.
4. Basements with a ceiling height of less than 80 inches (2032 mm) shall not be required to have emergency
escape and rescue windows.
§1009.2 Minimum size. Emergency escape and rescue openings shall have a minimum net clear opening of 5.7
square feet (0.53 m^2).
EXCEPTION: The minimum net clear opening for emergency escape and rescue grade floor openings shall be
5 square feat (0.46 m^2).
§1009.2.1 Minimum dimensions. The minimum net clear opening height dimension shall be 24 inches (610
mm). The minimum net clear opening width dimension shall be 20 inches (508 mm). The net clear opening
dimensions shall be the result of normal operation of the opening.
§1009.3 Maximum height from floor. Emergency escape and rescue openings shall have the bottom of the clear
opening not greater than 44 inches (1118 mm) measured from the floor.
§1009.4 Operational constraints. Emergency escape and rescue openings shall be operational from the inside of
the room without the use of keys or tools. Bars, gdlles, grates, or similar devices are permitted to be placed over
emergency escape and rescue openings provided the minimum net clear opening size complies with §1009.2 and
such devices shall be releasable or removable from the inside without the use of a key, tool, or force greater than
that which is required for normal operation of the escape and rescue opening. Where such bars, grilles, grates, or
similar devices are installed in existing buildings, smoke alarms shall be installed in accordance with §907.2.10
regardless of the valuation of the alteration.
§1009.5 Window wells. An emergency escape and rescue opening with a finished sill height below the adjacent
ground level shall be provided with a window well in accordance with §1009.5.1 and §1009.5.2.
§1009.5.1 Minimum size. The clear horizontal dimensions of the window well shall allow the emergency escape
and rescue opening to be fully opened and provide a minimum accessible net clear opening of 9 square feet
(0.84 m^2), with a minimum dimension of 36 inches (914 mm).
§1009.5.2 Ladders or steps. Window wells with a vertical depth of more than 44 inches (1118 mm) shall be
equipped with an approved permanently affixed ladder or steps. Ladders or rungs shall have an inside width of
at least 12 inches (305 mm), shall project at least 3 inches (76 mm) from the wall and shall be spaced not
more than 18 inches (457 mm) on center vertically for the full height of the window well. The ladder or steps
shall not encroach into the required dimensions of the window well by more than 6 inches (152 mm). The
ladder or steps shall not be obstructed by the emergency escape and rescue opening. Ladders or steps
required by this section are exempt from the stairway requirements of §1003.3.3.
