(631) 765-1809 · Fax (631) 765-9064 FI~DINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 1, 2005 ZB File No. 5779 - MARTIN KOSMYNKA, Contract Vendee (Tide Group, Current Owner) Property Location: 50 Commerce Drive, Cutchogue CTM 144-2-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 3.07 acre vacant site has 98 feet along Commerce Drive (cul-de-sac) in Cutchogue, and is located in the Light Industrial Zone District. BASIS OF APPLICATION: Building Department's August 2,2005 Notice of Disapproval, citing Section 100- 43C in its denial of an application for a building permit for an accessory apartment within a public storage building is not permitted under the provisions of the zoning code for accessory uses. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: VARIANCE RELIEF REQUESTED: The applicant wishes to add a 902 sq. ft. Apartment dwelling unit, next to the 725 sq. ft. office area, all within one of the proposed new buildings (building referred to as Phase I) to be built for public storage use in this Light Industrial Zone District. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new apartment (dwelling) unit will consist of 902+- square feet and is proposed for the purpose of residency by the manager-employee of the public warehouse facility at this site. Access to the storage units by the public is available 24 hours a day by the employees of the warehouse facility. If the variance were not approved, an employee would not be able to reside at the site as part of the management and security of the public warehouse operations. 2. The benefit sought by the applicant for on-site living space for the manager of the public warehouse facility cannot be achieved by some method, feasible for the applicant to pursue, other than by approval from the Zoning Board of Appeals for variance relief. 3. The difficulty was self-created when plans were designed for a business with a residential unit in a Light Industrial Zone District. 5. No evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an apartment for the employee-manager of the public warehouse facility, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 4/6/05 site plan (A-1) and A-O Plan of elevation and screening, prepared by DiGiovanni & Associates, Architects, SUBJECT to the condition that the occupant of the accessory apartment must be employed as the public storage/warehouse manager. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In reference to the above, the Planning Board held a work session on February 5,2007 to discuss the approved site plan prepared by Kenneth H. Beckman, L.S. dated December 2001, and last revised February 6, 2006, the resolution dated March 14,2006, the as-built survey last revised October 27,2006 and staff site visit comments regarding the above referenced site plan. In reference to the above, the Planning Board has determined the site plan requirements have been satisfied partially for the two buildings constructed and include the following items: · The Planning Board approves the as-built survey revised October 27,2006 for the building location as shown noting that handicap parking stalls, access aisles and signage must comply with New York State Code and ADA requirements. · Outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. All lighting must meet town code requirements. · It is the applicant's responsibility to ensure all necessary safety precautions have been provided during the completion of the construction at the site for anyone utilizing the storage facility. In reference to the above, the Planning Board held a work session on April 30, 2007 to discuss the approved site plan prepared by Kenneth H Beckman, L.S. dated December 2001 and last revised February 6, 2006, the resolution dated March 14,2006 and staff site visit comments regarding the above referenced site plan. The Planning Board is currently reviewing a site plan amendment for the construction of a new 40,050 sq. ft. 2-story storage building (with basement). The Planning Board has determined the site plan requirements have been satisfied for the 14,4000 square foot building labeled "Phase I" and include the following items: · All handicap parking stalls, access aisles and signage must comply with New York State Code and ADA requirements. · Outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. Final site plan satisfaction forthe proposed amendment currently under review in this office will not be issued until the final asphalt base for the entire site has been completed. In the event the amended site plan approval is not issued and the applicant does not construct the final two (2) buildings as approved by the Planning Board on March 14,2006, the applicant must install the final asphalt base within six (6) months from the written request of the Planning Board. .,. The owner must contact the Planning Department prior to the issuance of a certificate of occupancy for final site plan inspection upon the completion of any additional buildings/construction onsite. · As per landscape sUlVivability, the applicant agrees to replace any of the landscaping which dies within three (3) years of planting. · All leaders/gutters on the three (3) existing buildings must be installed within six (6) months from the date of this letter. · The applicant agrees to control all stormwater runoff onsite. I l \ ._~ \,,.-.,.......-- Dear Mrs. Woodhouse: During a recent site inspection of the above referenced project, it came to my attention that a concrete pad and/or underground electrical vault had been installed on the adjacent property. This concrete pad is located within the twenty (20') foot wide Landscaped Buffer Area surrounding the subdivision recharge basin that is currently owned by Tide Group Inc. & Mr. Henry Raynor. (See the enclosed photocopy of the partial site plan for the approximate location.) I have reviewed this encroachment with the Highway Superintendent and the Town Attorney's Office. The Developer was initially contacted regarding this encroachment and several conversations took place related to how and why this L1PA Service was located on the adjacent property. Since that time, a large green "above ground" utility control panel was installed on top of this concrete slab. At the direction of Mr. Harris and the Town Attorney, please notify the Developer that this encroachment must be removed and the electrical service should be relocated to one of the various landscaped islands adjacent to the entrance of the site. This location should be reviewed and approved by the Planning Board and Highway Department prior to the relocation of this equipment. The following has occurred on the matter of holding the certificate of occupancy for the above referenced property because of the electrical vault/box encroachment on the drainage basin property known as SCTM 1000-1-1.10. The Planning Board held a work session last night and discussed the site plan satisfaction letter dated May 7, 2007. At this time the Planning Board has no other issue with the electrical vault placement and still agrees with the conditions of the original satisfaction letter. The planning Board recommends the c/o be issued on the third building as indicated in the letter. Peter Harris the Superintendent of Highways has verbally stated that this electrical vault is ok as long as the c/r easement is reviewed to protect the Town and filed to the satisfaction of the Assistant Town Attorneys legal approval. Additionally, Pete requested that the location of future electrical vaults within a drainage area be avoided. FIRE APPARATUS ACCESS ROAD. A road that provides fire apparatus access from a fire station to a facility, building or portion thereof. This is a general term inclusive of all other terms such as fire lane, public street, private street, parking lot lane and access roadway. SF503.2 Specifications. Fire apparatus access roads shall be installed and arranged in accordance with 9F503.2.1 through 9F503.2.7. SF503.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than 20 feet (6096 mm),except for approved security gates in accordance with 9F503.6, and an unobstructed vertical clearance of not less than 13 feet 6 inches (4115 mm). SF503.2.2 Authority. The code enforcement official shall have the authority to require an increase in the minimum access widths where they are inadequate for fire or rescue operations. SF503.2.3 Surface. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be surfaced so as to provide all-weather driving capabilities. 9F503.2.4 Turning radius. The required turning radius of a fire apparatus access road shall be determined by the code enforcement official. SF503.2.5 Dead ends. Dead-end fire apparatus access roads in excess of 150 feet (45 720 mm) in length shall be provided with an approved area for turning around fire apparatus. SF503.2.6 Bridges and elevated surfaces. Where a bridge or an elevated surface is part of a fire apparatus access road, the bridge shall be constructed and maintained in accordance with AASHTO Standard Specification for Highway Bridges. Bridges and elevated surfaces shall be designed for a live load sufficient to carry the imposed loads of fire apparatus. Vehicle load limits shall be posted at both entrances to bridges when required by the code enforcement official. Where elevated surfaces designed for emergency vehicle use are adjacent to surfaces which are not designed for such use, approved barriers, approved signs or both shall be installed and maintained when required by the code enforcement official. SF503.2.7 Grade. The grade of the fire apparatus access road shall be within the limits established by the code enforcement official based on the fire department's apparatus. SF503.3 Marking. Where required by the code enforcement official, approved signs or other approved notices shall be provided for fire apparatus access roads to identify such roads or prohibit the obstruction thereof. Signs or notices shall be maintained in a clean and legible condition at all times and be replaced or repaired when necessary to provide adequate visibility. SF503.4 Obstruction of fire apparatus access roads. Fire apparatus access roads shall not be obstructed in any manner, including the parking of vehicles. The minimum widths and clearances established in 9F503.2.1 shall be maintained at all times.
