TO ALL TO WHOM THESE PRESENTS SHALL COME, GREETING:
kru= gq That, pursuant to resolutions Of the Board of Commissioners
of the Land Office, adopted January 9v 1951 and kay 1, 1951 and in
consideration of three hundred eighty-five dollars (9"385.00), law-
ful money of the United States, paid by John Arthur Pell, residing
at No. 218 Atlantic Avenue, in the Village of Greenport, County of
Suffolk and State of Now York, William Rodman Pell, residing at
No. 214 Atlantic Avenue, in the Village of Greenport, County of
Suffolk and State of New York and Fannie Pell, residing at No. 218
Atlantic Avenue, in the Village of Greenport, County of Suffolk and
State of New York, and upon the condition hereinafter expressed, we
.have given and granted and by these presents do give and grant unto
the said JOHN ARTHUR PELL WILLIM RODMAN PELL AND FANNIE PELL, the
owners of the land adjacent to the land hereinafter described, thei
heirs, successors and assigns in interest (hereinafter referred to
as the patentees), the following described land under water, to
wit:
All that parcel of land, now or formerly under the waters of
Sterling Basin, in the Village of Greenport, Town of Southold,
County.of Suffolk and State of New York, bounded and described as
follows:
— Beginning at the point of intersection of the original nigh
water line of Sterling Basin with the southerly line of.14onsell
Place, said point being North sixty-one degrees, twenty-five min-
utes East, one hundred fifty-five feet from the intersection of the
southerly line of Aonsell Place with the easterly line of Atlantic
Avenue; thence along the prolongation of.said southerly line of
Monsell Place and into the waters of Sterling Basin North sixty-one
degrees, twenty-five minutes East, forty-seven feet; thence South
twenty-eight degrees, thirty-five minutes East, eighty feet to an
intersection with the prolongation of the boundary lire between the
.property of John Arthur Pell, William Rodman Pell and Fannie Pell
and the property of Raymond Bishop and Frances Bishop; thence along
the prolongationof said.boundary line South sixty-one degrees,
twenty-five minutes west, forty-seven feet to an.intersection with—

the original high water line; thence along said high water line
North twenty-eight degrees,. thirty-five minutes West, eighty. feet
to the:.point of beginning; containing three thousand seven hundred
sixty square feet,. moreor less.
All bearings arereferred to .the true meridian.
These letters-patent are issued, however, and this grant is
made and accepted upon the express condition that if the State of
New York shall at any time hereafter acquire said premises and im-
provements� or a part of portion thereof, by appropriation or other.
wise, .the liability of the State shall be limited to the amount
paid by said patbntees to the State for this patent, or a proper
-
tionate part thereof, .together with the expenses necessarily in-
curred by the patentees for the acquiring of this patent, which are
hereby.fixed at the sum of 4350, and, also, the value of the im-
provements on said premises, or the proportionate part thereof
which may be so acquired. The value of such improvements if all
. are soacquired, or. such proportionate part of the amount paid by
said patentees for this patent..and of the value of such improve-
ments on a portion of,such lands which may be so acquired by the
State, and alldamages,. if any, to.the remainder of such improve-
ments which may:not be so acquired,.to be paid by the State of
New York, shall be determined as provided by the legislature author
izing such acquisition.
—_These.letters-patent are issued, pursuant to the provisions of
. Section 11 of .the Public Lands Law, for the purpose only to correct
an error in thedescription in .letters-patent issued to JOHN ARTHUR
PELL, WILLIAM RODMAN PELL AND FANNIE PELL, January 24, 1951 and
recorded in the Department of State, .Albany, New York, in Book of
