BAIN AND LINDA MILLER BAIN, HIS WIFE, both residing at 15 West 72"a Street, Apt. 17E, New York, New York 10023 Party of second part, WITNESSETll, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the part of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a'.point on the northerly line of Pine Neck Raod at the southeasterly comer of land heretofore conveyed by the party of the first part to Herbert W. Wells, Jr. and wife by deed dated November 16, 1956 and recorded in the Suffolk County Clerk's Office on November 19, 1956 in Liber 4215 of deeds at page 490; RUNNING THENCE in a northerly direction along said land of Wells, North 8 degrees 12 minutes 10 seconds West a distance of 177.40 feet to the southerly line of a certain 20 foot right of way; THENCE continuing on the same course North 8 degrees 12 minutes 10 seconds West, a distance of 10.0 feet to the center line of said 20 foot right of way; THENCE along said center line of said right of way, two (2) courses as follows: I. North 82 degrees 29 minutes l0 seconds East, a distance of 179.81 feet; 2. South 6 degrees 35 minutes 20 seconds East, a distance of 184.93 feet to said northerly line of Pine Neck Road; THENCE along said northerly linc Pine Neck Road, South 81 degrees 40 minutes West, a distance of 174.59 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE THE same premises conveyed to the grantor herein by deed dated September 16, 1957 and recorded in the Office of the Suffolk County Clerk on September 18, 1957 in Liber 4362 cp. 97. TOGETHER with all right, title and interest, if any, of thc party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party &the second part, the heirs or successors and assigns of thc party of the second part forever. AND the party of the first part covenants that thc party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for thc purpose of paying the cost of the improvement and will apply the same first to the payment &the cost of the improvement before using any part of the total of the same for any other purpose.
