This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

DESCRIPTION: Property is located in an R-40 Residential District. The
lot is situated on the west side of Westvww Drive with 75 ft. frontage on
Mattituck Ctl:'eek. It contains a total lot area of 11,761 sq. ft. and is
improved whh a one-story frame dwelling (ref. survey dated Feb. 3, 1997).
BASIS OF ~PEAL: Build;in~ Inspector's November 21, 1996 Notice of
Disapproval, which .reads as follows: under Article XXln. Section
100-239.4. "propoeed construction is within 75 reet of an existing bulkhead,
concrete wall, riprap or similar structure adjacent to a tidal water body. It

single-family dwelling as ah9wn on map sketched in :red ink by applicant,
with a setback confirmed on 2/13/97 to be 52 feet (previously sketch
indicated Pl'Opoaal at 48 reet on a rough sketch) to the "wood bulkhead
along mean hi~h water."
REASONS FOR BOARD ACTION. DESCRIBED BELOW:
Grant of reUef as requested wnt produce an undesirable cbani8 in the
gel\eral setbacks established in the neighborhood. ..
Grant of alternative reUef will not pl'Oduce undesirable change or adverse
effect in tb4l general character of neighborhood wh1cl1 would be similarly in

Benefit cannot be achieved without a variance because of nonconforming lot
size, as wen as width and depth.

The following action was taken by the Board of "l:own Trustees
during its regular meetilllJ held on June 25, 1991, regarding the
above matter:
WHE.RBAS, MARIA ANDlUOPOULOS, applied to the Southold -rown.
Trus~ees for a pend t under the provisions of the wetland
Ordinance of the Town. of Southold, application dated April 1.1.,
1997, and,
WHEREAS, said application was referred to the southold Town
conservation Advls.ory CouncU for their findings and
recOIIII.endations, and
WHEREAS, a Public Hearing was held by the 'fawn -rrustees with
respect to said applica:t.ion on June 25, 1997, at whi..cb time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in questi.on and the surrou!1C:U.,ng area,
and,
WHBREAS, the Board baa considered all the testi.mony and
docwnentati.on suanitted conceming this appli.cat1.an., and,
WHEllEAS 1 the structure complies with the s.tand~Td set -~orth in
Chapter 97-18 of the Southol.d Town code,

RESOLVED, that the Board of Trustees approves the application of
MARIA ANDRIOPOULOS to extend an existing deck to a total of
22' X 25' and add a 10' X 22' extension onto this existing' deck
and for an existinq 15' retaining wall, and maintain a 101 nan-turf buffer
landward of oulkhead.
BE IT FURTHER RESOLVED that this determination should not be
cons1.dered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar proj-ect.

sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
