Dear Sir/Madam:
An inspection on August 8, 2006 by a representative(s) of this department indicated that the Tennis
Pavilion at the above referenced site has been occupied and the wastewater from that facility is being
discharged into a renovated septic system without final approval from this department. This occupancy and
discharge without final approval from this office is a violation of Articles 5, 6 and 7 of the Suffolk County
Sanitary Code. You are hereby ordered to cease such use until such time as final approval of the installation of
the renovated septic system and extended water supply to the structure has been granted.
Please take note that this illegal occupancy and use will be grounds for this office to initiate formal
proceedings for the alleged violation(s).

Property location: South Side of East End Road, Fishers Island CTM 4-6-9
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's parcel is improved with an existing maintenance
building, adjacent to the Fishers Island Golf Club facility OVl this 12.3+- acre parcel.

BASIS OF APPLICATION: Zoning Code Section 19~-31B(7) which states that a Special Exception is
required for:
Beach clubs, tennis clubs, country clubs, golf clubs and annual membership clubs and accessory
playgrounds, beaches, swimming pools, tennis courts, recreational buildings and maintenance
buildings catering exclusively to members and their guests, subject to the following requirements:
(a) No building or part thereof or any parking or loading area shall be located within 100 feet of any
street line or within 50 feet of any lot line.
(b) The total area covered by principal and accessory buildings shall not exceed 20% of the area of
the lot.
(c) No such use shall occupy a lot with an area of less than three acres.
The applicant proposes new construction of a tennis pavilion and related structures (pro shop with office,
bathroom, screened porch area, tennis court, and related) for private use by members of the Fishers Island
Golf/BeachlTennis Club on this 12.3+- acre parcel, as shown on the January 14, 2004 map prepared by
CME Engineering land Surveying and Architecture, PllC, revised May 25, 2004.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal
inspections, the Board makes the following findings:

1) The applicant seeks approval to build tennis club structures for private use by members of the Fishers
Island Club. It is the determination of this board that the operation as a tennis club facility will not in any
way alter the character of the neighborhood or district.
2) Section 100-31 B(7) authorizes tennis clubs catering exclusively to members and their guests,
subject to the following requirements:
(a) No building or part thereof or any parking or loading area shall be located within 100 feet of any
street line or within 50 feet of any lot line.
(b) The total area covered by principal and accessory buildings shall not exceed 20% of the area of
the lot.

3) In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in
Section 100-263 and finds:
(c) No such use shall occupy a lot with an area of less than three acres.
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts.
B. That the use will not prevent the orderly and reasonable use of permitted or legally established
uses in the district wherein the requested use is located or of permitted or legally established uses in
adjacent use districts.
C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will
not be adversely affected by the proposed fitness facility use and its location.
D. That the use will be in harmony with and promote the general purposes and intent of this
chapter.
E. That the use will be compatible with its surroundings and with the character of the neighborhood
and of the community in general, particularly with regard to visibility, scale and overall appearance.
F. That all proposed structures, equipment and material shall be readily accessible for fire and police
protection.
BOARD RESOLUTION: In considering all of the above factors and applying the standards under New York
Town Law 267, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried to

The fOllowing resolution was adopted at a meeting of the South old Town Planning
Board on Monday, August 8, 2005:
WHEREAS, the applicant, Fishers Island Club, proposes a new tennis pavilion of 954
sq. ft. on an 11.92-acre parcel in the R-120 Zoning District located on the sisto East End
Road on Fishers Island, SCTM#1000-4-6-9; and
WHEREAS, Fishers Island Development Corporation is the owner of the property; and
WHEREAS, on August 10, 2004, the Planning Board granted conditional final approval
on the site plan prepared by CME Associates Engineering, Land Surveying &
Architecture, PLLC and certified by Richard H. Strouss, Professional Engineer, dated
March 12,2004 and last revised November 19,2004; and
WHEREAS, on July 08, 2005, the Suffolk County Department of Health Services
(SCDHS) approved the site plan prepared by CME Associates Engineering, Land
Surveying & Architecture, PLLC and certified by Richard H. Strouss, Professional
Engineer, dated March 12, 2004 and last revised June 10, 2005 for the SCDHS, under
reference number C1 0-05-0006; and
WHEREAS, the following item is incorporated and included in the site plan:
All ground and/or building mounted signage be submitted to the Planning Board for
review prior to installation.

At the request Paul Contillo of Z&S Contracting, the general contractors for the golf course tennis
pavilion project, I visited the site to review the rough framing.
During my visit, I noted several issues which needed to be addressed and since have been rectified.
Based on my review, the rough framing is in substantial conformance with the construction documents.

Dear Damon:
I have enclosed a print of the most recent site plan for the tennis pavilion at
Fishers Island Club.
If you believe any action by the Zoning Board is necessary (variance or
special exception use), please issue a new (or revised) Notice of Disapproval so that I can
make appropriate applications.
Please keep in mind that this is waterfront property and Fishers Island
Development Corporation owns not only the land where the pavilion will be built but also
the road and the land on the other side of the road. We are not aware of any defined right-
of-way for the road so the surveyor measured the setback from the edge of the pavement.
