MAZZAFERRO, residing q M at 215 Oak Street, Greenport, Suffolk County, New York, party of the second M Part, WITNESSETH: - -' WHEREAS; foie"party of the firstpart is the owner of the following premises, to wit:- ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Incorporated Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: On the North by land of Schiavoni. Formerly of DeDuck; on the East by land now or formerly,of Piccozzi; on the South by land of Nanni and on the West by'Sixth Street. Said premises being 40 feet in width front and rear and about 165 feet in depth. BEING and intended to be the same premises conveyed by Antonio Nanni and Antionette Nanni to Oscar Goldin by deed dated March 30, 1962, and recorded in the Suffolk County Clerk's Office on April 2, 1962, in Liber 5146 of Deeds at page 124. .t And the party of the second part is the owner of the adjoining premise , to wit:- ALL that certain plot, piece or parcel of land with the buildings and improvements thereon situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of,New York, being a portion of lots Nos. 96 and 97 on a certain map of'the Wiggins Estate signed by Nathaniel Corwin, Sidney L. Grilling and J. Wickham Case, Commissioners in Partition, which said premises are bounded and described as follows: Beginning at a point on the northerly line of the right of way of the Long Island Rail Road Company adjoining the easterly line of lot No. 141 as laid down on said map of the Wiggins Estate and running thence northerly partly by the easterly line of lot No. 141 and partly by the easterly line of lots Nos. 142 and 143, 110 feet, more or less, to land now or formerly of James Heaney and known as lot No. 95 on said map of Wiggins Estate; thence =_ easterly along the southerly line of land now or formerly of James Heaney 44.8 feet to the fence separating the premises herein ' described from land now or formerly of Jennie Hartley; thence southerly along said fence Iine, 38 feet to an angle in said fence line; thence southerly still along said fence line, 47.8 feet to a corner, and thence continuing southerly 15 feet, more or less, l I�ER5615 P F536 to the northerly Iine of said right of way of the Long Island Rail Road Company, thence westerly along the northerly line of said right of way to the point or place of beginning, and WHEREAS, the structure now erected on the premises of the party of the second part encroaches upon the premises of the party of the first part along the easterly boundary line of said premises of the party of the first part, NOW, THEREFORE, in consideration of the sum of One ($I,00) Dollar and other good and valuable consideration paid by the party of the second part to the party of the first part, the receipt whereof is hereby acknowledged, the party of the first part grants and conveys to the party of the second part, his heirs and assigns forever the right and easement to maintain that portion of the present structure upon the above described premises of the party of the second part which encroaches upon the premises of the party of the first part as aforesaid as Iong as that part of the present structure stands, IN WITNESS WHEREOF, the party of the first part has signed and
