Undercliff Terrace, West Orange, New Jersey, party _ # of the second part, m m WITNESSETH, that the parties of the first part in consideration of One Dollar ($1.00) lawful money of the United States, and other valuable consideration paid by the party of the second part, do hereby grant, remise, release and quitclaim unto the party of the second part, her heirs and assigns forever, ALL that certain lot, piece or parcel of land with any building and improvements thereon erected, being part of the land and premises owned by RUTH M. HART and JAMES A. CORWIN, and situate, lying and being in the Village of Greenport, in the County of Suffolk and State of New York, and which said lot hereby conveyed ds more particularly bounded and described as follows:'/IOton c�-� S01,40)d BEGINNING at a point which is the northeasterly corner of the premises hereby conveyed, which is also the northwesterly corner of a lot of land conveyed or about to be conveyed to James A. Corwin, which point is seventeen and five-tenths feet east, on a course of south sixty-eight degrees fifty-three minutes twenty seconds east, from the northwesterly corner of a lot of land conveyed in approxi- mately 1934 to Joseph Schmidt, said point being halfway along the northerly line of the premises previously conveyed from Katharine Robinson Brostrom, as Executrix of the Last Will and Testament of Alberta E. Robinson to Katharine Robinson Brostrom, individually, by deed dated September 11, 1937 and recorded in the office of the Clerk of Suffolk County, State of New York on September 16, 1937 in Liber 19h4. pages 523 to 525; thence (1) from said point of beginning westerly along the said northerly line north sixty-eight degrees fifty- three minutes twenty seconds west a distance of seventeen and five-tenths feet to the northwesterly corner of the lot herein described and the northeasterly corner of the ;aid lot previously conveyed to Joseph Schmidt; thence (2) running southerly and along the easterly line of said Schmidt's lot and on a course of south twenty-one degrees six minutes forty seconds west a distance of one hundred thirty-six 2nd thirty- six hundredths feet to a point in the southerly line of land U05173 eece476 granted by The People of the State of New York to Sandy Beach Association of Greenport, N.Y., Inc. and which grant y or patent is recorded in the office of the Secretary of State of the State of New York and is also recorded in the Office of the Clerk of Suffolk County, New York, and which point is the southwesterly corner of the premises herein described and the southeasterly corner of the said Schmidt's lot; thence (3) running in an easterly direction and along the southerly line of said grant or patent on a course of south sixty-six degrees twenty-three minutes ten seconds east a distance of thirty-seven and fifty-four hundredths feet to a point which is the southeasterly corner of the premises herein described and the southwesterly corner of the lot of land conveyed or about to be conveyed to James A. Corwin; thence (4J running in a northerly direction and along the westerly line of the said lot conveyed or about to be conveyed to James A. Corwin on a course of north seventee degrees twelve minutes twenty seconds east a distance of fifty-nine and seventy-three hundredths feet; thence (5) still along the westerly line of the lot of land conveyed or about to be conveyed to James A. Corwin in a northerly direction and on a course of north nine degrees thirty-six minutes forty seconds east a distance of eighty feet to the point of beginning. The above mentioned bearings are according to the true north meridian. Together with the riparian rights in Greenport Harbor in front of and abutting the premises hereby conveyed. Subject however to easements by way of right-of-way over and upon the northerly thirty feet of the premises here- in conveyed; and together with easements by way of right-of- way over other portions of the right-of-way which embrace the northerly thirty feet of the premises of Sandy Beach Association of Greenport, N.Y., Inc. between the lands formerly owned by Inez Fordham on the east thereof and the lands formerly owned by Herbert Fordham on the west thereof. Being or intended to be the approximate westerly hal of the premises conveyed to Alberta E. Robinson and Katharine obinson Brostrom by Sandy Beach Association of Greenport, .Y., Inc. by deed dated December 10, 1934 and recorded in the office of the Clerk of Suffolk County on December 17, 934 in Liber 1793 of deeds, pages 490 to 493; being the ame property later conveyed from Katharine Robinson .. _ . . . .. . . _ _ La%5173 FacA77 Srostrom, as Executrix of the Last Will and Testament of --lberta E. Robinson, to Katharine Robinson Brostrom, indi- J viduall y, by Executor's Beed dated September 11, 1937 and recorded in the office of the Clerk of Suffolk County, New York on Sentember 16, 1.937 in Liber 194¢ pages 523 to 525: being the same premises devised to dames A. Corwin and Ruth M. Kart by the Last Will and Testament of Katharine Robinso Brostrom which was dated December 13, 1944 and which was probated on Febroary 19, 1945 in the Surrogate's Court, Suffolk County, Riverhead, New York, Docket No. 28-P-1945. This description has been drawn in accordance with a. survey entitled "Map of Certain Lots At 'Sandy Beach' Greenport, N.Y.", made by Otto W. Van Tuyl & Son, Licensed Land Surveyors, Greenport, New York, dated September 19, 1951, and this conveyance is intended to be in accordance with the data therein contained. Also, together with a right-of-way, in common with others, upon over and across a parcel of land adjoining sai last above mentioned right of way on the north thereof, and which parcel of land is referred to as parcel "C" in the interlocutory judgment of 1929 in the partition action in t e County Court, Suffolk County, entitled Archibald N. Young plaintiff, against Nettie E. Hall and others, defendants, which said last mentioned right of way extends north to ManhansetAvenue. These premises herein granted are conveyed subject to any and all easements and restrictions contained in former deeds and agreements of record if any there be in force or effect. It is further mutually understood and agreed between the parties hereto as follows: 1. That no building shall be erected upon above described premises that is obnoxious or offensive by reason of the emission of noise, odor, or gas. 2. That no part of the above described premises shall be used for public fishing, boat letting, or for duck raising, public bathing beach, or any other commercial or business enterprise. 3. That no building, including porch, shall be erected or moved on the above described premises unless the same shall be set back at least (20) twenty feet from the bulkhead or front property line of the above -3-
