The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, December 12, 2007:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #6525 remove and replace 70 linear feet of existing navy bulkhead in the same
location and up to 18" higher and to remove and replace the existing 18' return located
approximately 13' from the northern property line, with a 10' non-turf buffer installed
landward of the bulkhead, and in accordance with the plans last revised on August 9,
2007 prepared by Tom McHenry, received on December 6,2007.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Permittee:
Your recent request to modify the above permit has been reviewed pursuant to 6 NYCRR Part
621 (Uniform Procedures Regulations). It has been determined that the proposed modifications
will not substantially change the scope of the permitted actions. Therefore, the permit is
modified to authorize:
Removal and replacemen!...Q{ 70 lineal: feet of existing navy bulkhead in the s~e location and up
to 18 inches higher and r~val and replacement of the eXi=g 18 foot return located
approximately 13 feet from the northern property line. A b may be docked at the floating
dock. All work shall be performed in accordance with the plans prepared by Tom McHenry last
revised on 8/9/07, and stamped NYSDEC approved on 12/3/07.
Special condition numbers 1,2, and 3 of the permit are revised and special condition numbers 13
and 14 are added to the permit as follows.
1. The storage of construction equipment and materials shall be confined within the project
work area (barge) and/or upland areas greater than 50 linear feet from the tidal wetland
boundary. The barge may be docked only at the floating dock.
2. Equipment operation (except for the docking of a barge and or boat at the floating dock)
seaward of apparent high water is strictly prohibited.
3. The new bulkhead shall be constructed in place of the existing bulkhead with no seaward
extension of the outermost bulkhead face.
B. No fill is authorized to be placed in tidal wetland areas.
14. No disturbance to the mussel bed offshore of the bulkhead shall occur as a result of this
project.
This letter is a modification to the original permit, and as such, shall be available at the job site
whenever authorized work is in progress.

RE: Bulkhead PermIts for 4605 Stillwater AVenue
Dear Mr. Wilm:
As we discussed, upon inspecting your property at 4605 Stillwater Avenue, Cutchogue and
reviewing the permits from the New York State Department of Environmental Conservation
(NYSDEC), I propose that the permits for both the NYSDEC and the Town of South old
Board of Trustees be amended.
The problem lies within the special con,ditions of the NYSDEC petroit which states that the
new bulkhead structure is to be constru,Cti:d ,behind the existing and then the existing be
removed. Upon my inspection, I found that there is a limited amount of sp!lCtl behind the
existing bulkhead. So limited, that therc' would be no room for the necessary fin behind the
bulkhead.

Since it would be most unlikely that Prrmits could be obtained to install the new bulkhead in
front of the existing, my recommendation is to amend the permits so that the new.bulkhead
w in$llled in-place of the existing. Even at that, the space is very tight and the
" ~J1!4d;~9\lij'e:helica1screws' to secure the bulkhead, . '.
. You will note that our original estilllate to you dated April 25, 2007 is based on replacing
the structure in place. As the strucj:ure is permitted now, Costello Marine Contracting would
not take on the work because the lack of space behind the existing bulkhead would prove to
unsuccessfully secure a new bulkhead structure behind it.

TERMS AND CONDITIONS
The Permittee Walter Wilm. residing at 4605 Stillwater Ave.. Cutchogue. NY, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of South old are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. McHenry:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., January 24, 2007 regarding the above matter:
WHEREAS, Liberty Permit & Research on behalf of WALTER WILM applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
South old Town Code, the Wetland Ordinance of the Town of Southold, application
dated December 12, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 24,2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of WALTER WILM to
replace approx. 70' of existing wood bulkhead with C-Loc vinyl sheathing installed
behind the existing wood sheathing, install a 12' return and a 20' return, and remove or
cut off the old bulkhead at mud level, with the condition a 10' non-turf buffer is installed
landward of the bulkhead and as depicted on the plans prepared by Thomas McHenry
last dated April 18, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

approx. 70' of existing wood bulkhead with C- Loc vinyl sheathing and install a 12' return and a
20' return. Located: 4605 Stillwater Ave., Cutchogue. SCTM#137-3-5
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states.
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".
