It appears that fill that has been placed on the site exceeds the elevation permitted. However, this determination is based on my own observation. It is recommended that you instruct the applicant to have the elevation at the site certified by a licensed professional to determine if the elevation is indeed excessive. .,,uuun to approve the application. .` � Y: Second. (ALL AYES) TRUSTEE DOHERTY: Number two, JAIME SANTIAGO requests a Transfer of Wetland Permit #4284 from George Case to Jaime Santiago as issued on February 24, 1994, and to Amend Permit #4284 to repair the beach stairs with the addition of two landings no larger than 32 square feet, and to renovate the existing beach house. Located: 3745 Nassau Point Road, Cutchogue. Basically he is doing everything in-place, he is just adding one more platform on the top because that's a rather long stretch, and as it says in here it will be no larger than 32 square feet, as in the code and this is exempt from the LWRP because it is just replacing what is there. We do not have a report from the CAC. I make a motion to approve the as submitted. TRUSTEE DICKERSON: Second. TRUSTEE KING: All in favor? (ALL AYES) TRUSTEE BERGEN: Number three, ANDREA PARKS requests an Amendment to Permit #6555 to move the proposed in-ground swimming pool 6 feet closer to the top of the bluff. Located: 3995 Nassau Point Road, Cutchogue. I went out and looked at this, it was found inconsistent under the LWRP, and that was because it was decreasing the distance between the bluff and the pool, the distance between the pool and bluff was decreased or being requested as a decrease, and the CAC went out and looked at it and they resolved not to support the application to move the proposed pool 6 feet closer to the top of the bluff. They did this because they felt that it would be too close to the top of the bluff. I don't know if there is anybody here representing? If you would introduce yourself please? MR. PARKS: I am John Parks. I am the home owner. TRUSTEE BERGEN: I did go out and look at this also and a concern I discovered was that in the original permit you came in for you proposed a retaining wall between your property and the next door neighbor's property to the north, and I noticed that it looks like the grade was filled in. I don't know if you buried the wall or the wall was not put in there, I did notice that there is the retaining wall that runs parallel to the bluff from your property going over to the property to the north. Did you do that other wall also and it's buried? MR. PARKS: Yeah, there is some measure of wall between the two properties. That was anticipated before the neighbor was putting in a retaining wall, so if they didn't have the front part, then our dirt would have spilled out, but now we both put one in across the front. TRUSTEE BERGEN: Correct. MR. PARKS: And there is also the wall that is still in the back. TRUSTEE BERGEN: I just didn't see it because I guess it is buried. The concern I had is the area between the current retaining wall that is there that again runs parallel to the top of the bluff and the bluff itself. In that area I did not notice any drywells. Cutchogue, NY 11935 RE: 3995 NASSAU POINT RD., CUTCHOGUE SCTM#1 1 1-9-5.1 Dear Mrs. Parks: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., December 12, 2007: WHEREAS, ANDREA PARKS applied to the Southold Town Trustees for an Amendment to Wetland Permit #6555 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 19, 2007, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policy: Policy 6.3 — Protect and restore tidal and freshwater wetlands, and, WHEREAS, the applicant has previously received an approval from the Board of Trustees dated March 21, 2007, providing for the location of the proposed structure at a distance that, in the Board's judgment, would further Policy 6 to the greatest extent practical, while accommodating for the applicant's need for relief from the strict requirements of Chapter 275, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, • 2 • WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure, in the location applied for, does not comply with the standards set forth in Chapter 275 of the Southold Town Code, and, WHERAS, the Board has determined that the structure, in the location applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that for the foregoing reasons, and based upon the application's failure to meet the standards contained in Chapter 275 of the Town Code, that the Board of Trustees deems the proposed project to be Inconsistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, based on the location of the proposed structure and it's proximity nearby the top of the bluff, and, BE IT FURTHER, RESOLVED, that the Southold Town Board of Trustees DISAPPROVES WITHOUT PREJUDICE the application of ANDREA PARKS to Amend Wetland Permit #6555 to move the proposed in-ground swimming pool 6' closer to the top of the bluff, and as depicted on the'survey prepared by MCH Design Services dated November 16, 2007. To summarize our solution to the elevation challenge, the Parks have agreed to create a swale on their property along their north property line in the approximate area from the bend of their driveway seaward to a spot about even with the northeast corner of their house. This swale will catch the water from their property and cause it to flow to the multiple catch basins which were located on their property under the large mound of soil. The Santiagos have agreed to create a small berm along the same property line area described above. Both parties agreed to plant native species of trees or shrubs along the property line which will also assist with ground water absorption. With these efforts in place, we all hope that it will bring both parties into compliance with Chapter 236 of the Town code for drainage. Again, I hope that these measures will enable both projects to move forward to completion. Thank you very much for your cooperation with this matter. Box 1179 Southold, NY 11971-0959 Dear Town Trustees: My name is Jaime Santiago, my wife Nancy and I are the new owners of 3745 Nassau Point Road, SCTM # 1000-111-09-4.1. Our property is adjacent to a parcel which is currently under review in reference to a bluff violation. The adjacent property is 3995 Nassau Point Road, SCTM # 1000-111-09-5.1 and 5.2., the owner of this property is the Parks family. My wife and I have been following the erosion problem of the bluff on the Parks property and the efforts on the part ofthe Town Trustees to correct the resulting damage to the bluff as well as developing a long term fix to this erosion problem. Obviously, as the contract vendee and now as the owner of this property, I am very concerned in reference to the possible loss of my staircase, my beach cabana and the overall health of this bluff. We attended the November meeting and were quite concerned that there were no plans for the review of the Board. We were quite concerned to hear that December passed and there were no plans prepared for that December meeting. Over this period of time, I have had engineers and other consultants reviewing the site conditions. It became evident, after our review, to all involved that there should be a joint solution between my property and the Parks property. To achieve that goal, I have had a joint meeting of the consultants for both the Parks and my properties. We have worked to develop a plan which would be mutually beneficial to both our parcels and hopefully to the Southold Town Trustees and the Town of Southold. We are aware that there is a hearing on January 24, 2007 and a Board site meeting on January 15,2007. We wish to be at both these meetings to participate in the discussion of a solution to the erosion on the bluff of the Parks property. We will be filing a formal application for work to be done on my property to mutually join with the work that will be . . · done on the Parks property. You will be receiving a survey which reflects both the Parks property and my own. The plan will show a retaining wall across the lower section of my tennis court proceeding across to the Parks property. This area will have drainage structures which will move water away from the bluff. We will be developing are-grading plan for the top of the bluff to move water to inlets away from the bluff and into drywells. My property on the bluff slope currently has a series of retaining walls. Hopefully, our plan will continue these retaining walls across our mutual property line into the area of the current erosion and help to stabilize that area. These elements of a joint plan will be present on the common survey that you will be receiving. We realize that our application will need to be submitted with public notice for comment and review by the Town Trustees. We would hope not to delay your actions in reference to the Parks application. The repair of the bluff with regard to the erosion that has taken place is of utmost importance to us. For that reason, we hope you can move on the matter before you of repairing of the bluff as soon as possible. During the heavy rains on September 14 and 15, significant failure of the bluff occurred. The Parks' are requesting an Emergency Permit for action to repair the damage and prevent further degradation of the bluff. Staked haybales and silt-fence are being installed in an effort to minimize further damage. However, there is need to design a grading and drainage plan for the entire site, which is underway. I will not have a complete application to submit in time for your October hearing, but plan to do so for the November hearing. As discussed at the September 20th work session, a member (or members) of the Board will inspect the premises, and the Board will determine at that time if an Emergency Permit is appropriate and whether or not any action beyond installation of the haybales and silt-fence will be necessary. I have requested that a check for the application fee be hand delivered to your office. Attached are site photographs and a sketch of the damaged area with the haybales and silt-fence indicated.
