At the January 24, 2007 Public Hearing of the Town Trustees, an amendment to Mary Zupa's dredging permit providing for relocation of the spoil site was approved. Subsequently, the NYSDEC denied our request to relocate the spoil site and granted alternate relief by authorizing the removal of the large rock in the original soil site. A copy of the NYSDEC's 5/1/2007 Modification of Permit is attached hereto. Please be advised that the modification to the Trustees Permit is no longer required and the activity approved under the original dredge permit is expected to take place next week. Paradise Point, Town of Southold Dear Permittee: The Department of Environmental Conservation has completed its review of your February 28,2007 request to modify the referenced Tidal Wetlands,Protection of Waters and Water Quality Certification permit to relocate the approved dredged material dewatering site in order to avoid a pile of large stones which have been placed in this area. We have determined, pursuant to the Uniform Procedures Regulations and other applicable regulations, that the permit should not be modified to authorize the requested change in dewatering site location. Instead,the stones should be removed from the dewatering site before the dredging project begins. The permit is hereby modified to authorize the removal of the stones now in the dredged material dewatering area from the Zupa property to an upland location for disposal. All terms and conditions remain as written in the original permit. This letter is a modification of the permit,and as such, must be available at the project site with the original permit and all approved plans whenever authorized activities are being undertaken. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. January 24, 2007 Jill Doherty 4 '4CQ1 Board of Trustees Town of Southold Dear Jill, As a follow up to our discussions over the past few days concerning repair of the west jetty, we understand the Trustees concerns about placing dredge spoil in same until a amore complete repair can be made. It has always been and continues to be our intention to fully repair the west jetty. We have been unable to do so primarily due to the lack of contribution from those homeowners who reside on the boat basin. By and large they have refused to contribute to capital assessments approved by the Paradise Point Association earmarked for the repair of the west jetty. The majority of the other Paradise Point Association members have contributed to this capital assessment. We have previously offered and continue to offer to recalcitrant members the ability to make direct payment of funds for repair of the west jetty to a contractor on behalf of the Association. If they are unwilling to pay the Association directly, we would then credit their account with the Association accordingly. Since the Paradise Point Association owns the west jetty, it would be imprudent to allow an individual member or members to unilaterally conduct repair work. The Association has an active dredge permit issued by this Board, and it is inappropriate to have duplicate permits for the same work.
