The action is located in a canal adjacent to Corey Creek; Corey Creek is a NYSDEC designated Critical Environmental Area and a New York State Significant Fish and Wildlife Area. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following Best Management Practices are applied to further Policies 5 and 6: 1. No CCA- treated lumber is used in the construction of the timber bulkhead. 2. A non-turf buffer at the maximum width practical is established landward of the new bulkhead. 3. A silt curtain is set in place to contain localized turbidity during construction, pursuant to 275-11 (2).
