GROSS as Sheriff of the County of Suffolk in the State of New York, party of the first part, and GEORGE M. TISDALE JV 4 SDTToN PLACE _ NEW YORK, NEW YORK yk party of the second part: WHEREAS, a certain Execution was issued out of the Supreme Court, Suffolk County, on the 20th day of October, 1967, on a - judgment entered In the Supreme Court, Suffolk County, in an action between GEORGE M. TISDALE as Plaintiff, and JOSEPH A. KRUPSKI as Defendant, on the second day of June, 1967, In favor of GEORGE M. TISDALE and against JOSEPH A. KRUPSKI for the sum of Eleven Thousand, Ninety One and no/100ths dollars ($11,091.00) as appears by the ,Judgment roll filed in the office of the Clerk of the -Supreme Court County of Suffolk, which said Judgment was docketed in the office of the Clerk of the County of Suffolk on the second day of June, 1967, and WHEREAS, said execution was directed and delivered to the Sheriff of the County of Suffolk commanding him to satisfy said Judgment out of the real property, among other property, of the ,Judgment debtor; and WHEREAS, under the term of the execution, the interest of the - judgment debtor in the premises hereinafter conveyed and described was, subject to the lien of said Judgment when the execution was so delivered; WHEREAS, the said Sheriff by virtue of and in obedience to the command of said execution duly sold at public auction on the thirteenth day of March, nineteen hundred and sixty eight, all the estate, right, title and interest which on • - the second day of June, 1967, or at any time thereafter, the said Judgment debtor had, of, in and to said premises having held the sale at Riverhead, New York in the said county of Suffolk, and having first given public notice of the time and place of such sale, by advertising, serving and posting the same according to law, at which sale the said premises were struck off to GEORGE M. TISDALE for the aum of Twenty Eight Thousand, Five Hundred Ninety Two and 13/100tbs dollars ($28,592,13) he being the highest bidder and that being the highest sum bidden for the same. WHEREUPON, the Sheriff of Suffolk County after receiving from the said purchaser the said a= of money so bidden as afore- - said, gave to said GEORGE M. TISDALE, the proofs of publication, service and pasting of the notice of said sale as directed by the law be given. NOW THIS INDENTURE WITNESSETH, That the said party of the first part, by virtue of the said Execution, and in pursuance of the act in such case made and provided, and in consideration of the sum of money so bidden as aforesaid, to him duly paid, HATH sold and by these presents DOTH grant and convey unto the said party of the second part, the heirs or successors and assigns of the party ofth• second part forever,all the estate, right, title and interest which the said defendant had on the second day of June, nineteen hundred and sixty seven or any time afterward, of, in and to ALL PARCEL I ALL that certain tract, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the northerly line of Central Avenue, distant 176.83 feet westerly along said linefroma concrete monument marking the intersection of said line with the ordinary high water mark of Greenport Harbor, and running thence (A) along is u the easterly line of a certain right of way north 15 degrees 7 minutes 30 seconds west, 115.03 feet to a point; thence (B) north 27 degrees 6 minutes 50 seconds west 49.54 feet to a point on the southerly bulkhead line of Hackett's Basin; thence through Beckett's Basin, two courses, as follows: (C) (1) north 15 degrees 29 minutes 10 seconds west, 89.50 feet to a point; (D) thence (2) north 47 degrees 44 minutes 30 seconds east, 70.0 feet to a Point; thence (E) on a line about north 40 degrees east, intended to be through the center of Hackett's Basin, to a point at the entrance thereof; thence (F) in a southeasterly direction about 17 feet to the former southerly bulkhead line of the said entrance to Rackett's Basin; thence (G) still in a general south- easterly direction along the existing bulkhead line (on a line approximately parallel with the established U.S. Pier and Bulk- head Line) to a point thereon (distant 100 feet from the point where said bulkhead turns nearly due south); thence along other lands of the parties of the first part, three courses, as fol- lows: (H) (1) south 20 degrees 45 minutes 00 seconds west, 128.2 feet to a point marked by an iron stake; thence (I) (2) south 74 degrees 04 minutes 30 seconds west, 44.81 feet to a point marked by an iron stake; thence (J) (3) south 9 degrees 27 minutes 00 seconds west, 169.11 feet to a point on the northerly line of Central Avenue; thence (K) along the northerly line of Central Avenue south 75 degrees 44 minutes 20 seconds west, 94.93 feet to the point or place of beginning. TOGETHER with all of the right, title and interest of the grantor of, in and to the waters and lands under the water in Hackett's Basin, and the entrance thereto, Stirling Basin and Greenport Harbor adjoining and adjacent to the premises above described, the stringers therein and the bulkheads therein and thereon. Together also, with all of the right, title and interest of the grantor of, in and to the right of way west of the course first herein described and the use thereof. PARCEL II ALL that certain plot, piece or parcel of land, with the build- ings thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point marked by a concrete monument set on the northerly line of Bay Avenue, or the extension easterly of said line, and running thence (1) along the northerly line of Bay Avenue and the extension easterly thereof south 74 degrees 15 minutes 50 seconds west 19.52 feet to a point where the norther- ly line of Bay Avenue is intersected by the land of Hackett; thence (2) north 25 degrees 05 minutes east 25.0 feet to a point; thence (3) north 15 degrees 35 minutes west 114.5 feet to a point on the southerly line of land of Baling; thence (4) north 74 degrees 42 minutes 50 seconds east 17.65 feet to a point; thence (5) north 6 degrees 57 minutes 30 seconds west 24.68 feet to a point; thence (6) north 14 degrees 6 minutes 30 seconds west 89.03 feet to a point on the southerly line of Central Avenue; thence (7) along the southerly line of Central Avenue north 75 degrees 44 minutes 20 seconds east 156 feet to a point; thence (8) south 14 degrees 15 minutes 40 seconds east 78 feet to a point; thence (9) south 84 degrees 43 minutes 40 seconds east 60.27 feet to a point on the outer edge of a bulkhead; thence (10) along the bulkhead, the docks, ordinary high water lines, under water grant lines of the parties of the first part, to the point or place of beginning: Specifically including the lands now or formerly under the waters of Green- port Harbor which were heretofore conveyed by the People of the State of New York to the R.W. Sweet Shipyard k Machine Works, Inc. by Letters Patent dated November 11, 1926 and recorded in the Suffolk County Clerk's Office on December 21, 1926 in Liber 1222 of deeds at page 333; ,. .; . Eiaee6321 oac.353; ' TOGETHER with all the riparian and under water rights of the - a grantor adjacent to said premises lying southerly from the course numbered 9 above and from a line beginning at the point on the bulkhead marking the southeasterly end of said course and running thence into the waters of Greenport Harbor on a - course running south 65 degrees 36 minutes east to the U.S. Pier and Bulkhead Line; TOGETHER, to the extent that the grantor has any interest or - rights therein and thereto, with a right to the grantor to use for = =_ the purpose of ingress and egress to and from piers and mooring places to beyond the U.S. Pier and Bulkhead Line, so - much of the present open waters as lie northeasterly of the line running from the bulkhead on a course south 65 degrees 36 minutes east to the said U.S. Pier and Bulkhead Line to - within 40 feet of the bulkhead on the adjacent property of - _ the parties of the first part and the southeasterly and south- westerly bulkhead and dock lines of the "Union Wharf" extend- ing into the waters of Greenport Harbor from Central Avenue. PARCEL III _ ALL that certain plot, piece or parcel of land, with the build- ings and improvements thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: _ BEGINNING at a point on the southerly line of Central Avenue _ -_ marking the northeasterly corner of Parcel II and running - thence in a northerly direction north 14 degrees 15 minutes - 40 seconds west, to a point on the northerly line of Central E Avenue; thence north 75 degrees 44 minutes 20 seconds east, about 45 feet to a concrete monument set at the intersection of the (former) ordinary high water mark of Greenport Harbor and the northerly line ofCentralAvenue; thence in an easter- ly direction, along the bulkhead line of the property known as "Union Wharf" and along the dock and bulkhead line thereof, and adjacent thereto, to a point on the bulkhead; thence north _ _ 84 degrees 43 minutes 40 seconds west, 60.27 feet to a point; thence north 14 degrees 15 minutes 40 seconds west, 78 feet to the point or place of beginning; _ TOGETHER with the right to moor and tie vessels to the bulkhead - comprising the northerly side of Union Wharf as far westerly _ along such side as a point which is distant 86 feet from the _ - concrete monument marking the termination of the course second described above, and as far northerly as a line midway between -�; the northerly side of Union Wharf and the southerly side of the - aap; wharf and dock adjacent on the north. PARCEL IV ALL that certain plot, piece or parcel of land with the build- ings and improvements thereon erected, situate, lying and being _ in the Village of Greenrort, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the northerly line of Central Avenue marking the southeasterly corner of Parcel I and running thence _ north 9 degrees 27 minutes 00 seconds east, 169.11. feet to a _ point; thence north 74 degrees 04 minutes 30 seconds east, 44.81 feet to a point; thence north 20 degrees 45 minutes 00 seconds - - east, 128.2 feet to a point on a bulkhead marking the most - easterly point on the adjacent premises of the party of the second part; thence along the several bulkhead, ordinary high water, and open dock lines in an average southerly direction to a concrete monument marking the former ordinary high water line of Greenport Harbor and the easterly terminus of the north- erly line of Central Avenue; thence along the bulkhead and dock lines of the property known as the "Union Wharf" and then in a - southwesterly direction along the bulkhead adjacent thereto to a point and other property of the party of the second part; thence u9fF6J3) _ vAGEJ5Y - north 84 degrees 43 minutes 40 seconds west, 60.27 feet to a point; thence north 14 degrees 15 minutes 40 seconds west, 78.0 feet to a point on the southerly line of Central Avenue marking the northeasterly corner of Parcel II; thence in a _ general northwesterly direction across Central Avenue to the point or place of beginning. TOGETHER with all of the right, title and interest of the party it of the first part of, in and to the water and lands underwater - _ in Greenport Harbor and Peconic Bay adjoining and adjacent to the premises above described, the stringers therein, and the bulkheads, piers and docks therein and thereon, and to so I- much of Central Avenue as is within the above described premises. i= _ TOGETHER with the right to moor and tie vessels to the bulkhead [_ comprising the northerly side of Union Wharf as far westerly along such side as a point which is distant 86 feet from the concrete monument marking the termination of the course second described above, and as far northerly as a line midway between the northerly side of Union Wharf and the southerly side of the f- Wharf and dock adjacent on the north. EXCEPTING FROM SAID PARCEL IV, however,so much of the above described premises as are described as follows: BEGINNING at a point on the southerly line of Central Avenue marking the northeasterly corner of Parcel II and running f thence in a northerly direction north 14 degrees 15 minutes 40 seconds west to a point on the northerly line of Central - Avenue; thence north 75 degrees 44 minutes 20 seconds east, about 45 feet to a concrete monument set at the intersection of the (former) ordinary high water mark of Greenport Harbor and the northerly line of Central Avenue; thence in an easterly - direction along the bulkhead line of the property known as "Union Wharf" and along the dock and bulkhead line thereof and adjacent thereto to a point on the bulkhead; thence north 64 degrees 43 minutes 40 seconds west, 60.27 feet to a point; _ _ thence north 14 degrees 15 minutes 40 seconds west, 78.0 feet to the point or place of beginning.
