RILEY, residing at 121 Mead,@aYbrook Road, Garden City, New York party of the first part, and JOSEPH OILEARY and EMILY OILEARY, his wife, both residing at 294 Carroll Street, Brooklyn, New York, party of the second part, WITNESSETH,that the party of the fit�sI�s, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part,•'doeal hejteby graat.and release unto the party of the second part, the heirs or successors and assigns of the party of f e second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, which on a certain map on file in the office of the Clerk of cr) the County of Suffolk entitled, "Map of the Wiggins Estate" and signed by Nathaniel Corwin, Sidney L. Griffin and J. Wickham Case, Commissioners in partition and filed under No. 534, are known and designated as Lot No. 117 and the southerly half of Lot No. 116, and which taken together are bounded \ and described as follows: X BEGINNING at a point in the westerly side of Fifth Street where same is intersected by the division line between lots 117 and 118 on said map, which point is at the Northeasterly corner of land conveyed to Harry Menkes by Liber 4905 of deeds page 94 and is distant 100. 12 feet Northerly from Clark �,. Street according to survey by Van Tuyi & Son dated September 10, 1970 and v from said point of beginning; " running thence North 82 degrees 41 minutes 00 seconds West along said land of Menkes and the division line between lots 117 and 118, 166. 18 feet to lot 122 on said trap; thence North 7 degrees 18 minutes 20 seconds East along the Easterly side of lots 122 and 123, 75. 10 feet; thence South 82 degrees 41 minutes 00 seconds East through lot 116, 166. 17 feet to the westerly side of Fifth Street; thence South 7 degrees 18 minutes 00 seconds West along the Westerly side of Fifth Street, 75. 10 feet to the point or place of beginning. TOGETHER with all right, title and interest,if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtensam and all the estate and rights of the party of the first part in and to said premises; TO HAVK AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assiou of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except As aforesaid. ' AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part wrll receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
