Review: I spoke with Eric Star, NYSDEC Environmental Program Specialist, Region 1, (444- 0405) regarding the interpretation of the Coastal Erosion Hazard Areas law. I have attached a copy of Chapter 111, Coastal Erosion Hazard Areas, and highlighted the areas that pertain to the evaluation and permitting of these proposals. The main points Eric made in my conversation with him were that in order to issue a permit as proposed: 1. There must be proof of erosion, evidence that the shoreline is unstable, and evaluation of the house being threatened; is the erosion from overland flooding or from the seaward edge? 2. Explore any reasonable alternatives (softer solutions to the size of the revetment) such as a berm on top of the bluff and establishment of a buffer/ plantings on the bluff face and between the bluff and the lawn, or design a revetment that included some fill and plantings in-between the rocks. ogpPF01,ro Telephone p Town Hall (631)765-1892 N 53095 Route 25 p • .F P.O.Box 1179 y fit' Southold,New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD At the meeting of the Southold Town Conservation Advisory Council held Wed., April 11 , 2007, the following recommendation was made: BARBARA DEFINA to remove the existing stone revetment and install approx. 107 linear ft. of new stone revetment along the situate shoreline to prevent further erosion. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes",then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net),the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable Subiect proposal is consistent with the policy in that the siting and utilization of the improved erosion - control facilities (i.e. stone revetment) will maintain the character of the surrounding neighborhood which currently consists of other similarly improved lots with similar accessory structures lie stone revetments to the north and south along Orient Harbor) In addition subject parcel will be in harmony with this "...beneficial use of a coastal location..." in that the subject waterfront lot will be enhanced and improved by the installation of the proposed stone revetment in order to control erosion along the situate shoreline The instant proposal will also "...minimize the adverse effects of development" in that proposed construction above the hiah water mark and utilization of siltation fencing and hay bales will reduce the impact caused by the proiect. Accordingly,we feel that the instant proposal complies with Policy 1 Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III—Policies Pages 3 through 6 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Policy 2 is not applicable in that subiect lot and the surroundina neighborhood cannot be deemed a substantial historic and/or archaeological resources Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III—Policies Pages 5 through 7 for evaluation criteria ® Yes ❑ No ❑ Not Applicable Subiect proposal will not adversely impact the visual auality of the surrounding area in that the proposal is to install a stone revetment along the situate shoreline of the subiect parcel The surrounding area is currently comprised of properties improved with similar appurtenances (i.e. stone revetments) of similar size and scope. Scenic resources assumedly views of Orient Harbor, are not at risk because the pr000sed revetment will not block any views of said resource In addition there is an existing stone revetment that has been in place within this property for years without negatively impacting upon the scenic resources of this section of waterfront Therefore we feel that the instant proposal complies with Policy 3 Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable Subiect proposal will fully comply with this Policy in that the proposed stone revetment is soecifically designed to minimize and/or prevent loss of life structures and natural resources from flooding and erosion In addition, the pr000sed construction above the high water mark rather than construction within the area of normal tide fluctuations will help to "manaae noviaation infrastructure to limit adverse impacts on coastal processes" by drastically reducina the amount of siltation caused by the proiect and thereby limiting impacts to the navigation of Orient Harbor. Therefore we feel that the instant proposal complies with Policy 4. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III -Policies Pages 16 through 21 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Policy 5 is not applicable to this proposal in that it will have no effect to the water quality/supply within the surrounding area Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III—Policies; Pages 22 through 32 for evaluation criteria ® Yes ❑ No ❑ Not Applicable Subject proposal will maintain the auality of the surrounding ecosystem in that the proposal is to simply install a stone revetment The existing stone revetment has existed thereon for many years without resulting in any form of discernible adverse effects to the surrounding environment Moreover, stone revetments in and of themselves have not been shown to adversely impact oauatic ecosystems The proposed stone revetment will prevent any further erosion to the orooerty, thereby preventing any upland soils from entering Orient Harbor. The choice to construct above the high water mark as appose to construction within the area of normal tidal fluctuations will further "protect and restore ecological auality " by limitina the amount of siltation caused by the instant proposal Therefore we feel that the proposal fully complies with Policy 6. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III - Policies Pages 32 through 34 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Policy 7 is not applicable to this proposal in that the proposal is simply to replace an existing timber bulkhead thereon and which will not result in any form of adverse effects to air quality. Accordingly, this proposal is not applicable with this policy. Attach additional sheets if necessary Policy 8.
