a 75' non-disturbance buffer. The proposed 75' limit is not permitted.
In addition, the proposed action is subject to a 1995 Conservation Easement, dated December 29,
1995, filed with the Clerk of Suffolk County in Liber DOOO1l756, Page 282; to the 1995
Conservation Easement, dated December 18, 1996, med with the Clerk of Suffolk County in Liber

To further the policies of the L WRP it is recommended that if the action is approved the Board
require gutters and leaders leading to drywells and a pervious driveway.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its

met with the issuance of the underlying subdivision approval,
we believe that no adverse impacts to the surrounding
environment are expected during and after construction of this
project.

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development, See L WRP Section III - Policies; Page 2 for evaluation
criteria.
~ Yes 0 No 0 Not Applicable
As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the Town of
South old would result in a loss of the community and landscape character of southold.", this is a proposal to
construct a sin!!le-family dwellin!! and related appurtenances within a lot created from a Town of Southold approved
subdivision. The proposal, as desi!!ned, will not result in any adverse impact to the surroundin!! environment in that
the project is si!!nificantly set back from both Lon!! Island Sound to the north, and from the freshwater wetlands frin!!e
to the south/southeast. As the lot was created from a Town of Southold approved subdivision, this proposal will fully
comply with this Town policy.
Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See
L WRP Section III - Policies Pages 3 through 6 for evaluation criteria
DYes 0 No ~ Not Applicable
Policy 2 is not applicable in that subject lot and the surroundin!! nei!!hborhood cannot be deemed a substantial historic
and/or archaeolo!!ical resources.
.
.
Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See
L WRP Section III - Policies Pages 5 through 7 for evaluation criteria
~ Yes D No D Not Applicable
Subject proposal will not adversely impact the visual quality of the surrounding area in that the proposed structures
will not be visible from the main access into the subdivision, and therefore will not impair the current visual and
scenic qualities already available. Again, as indicated within Policy 1, as the lot was created from a Town of Southold
approved subdivision, this proposal will fully comply with this Town policy. Ultimately, this policy could not
preclude the legal creation of this property as a building lot.
Attach additional sheets if necessary
NATURAL COAST POLICIES
Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See L WRP
Section III - Policies Pages 8 through 16 for evaluation criteria
~ Yes D No D Not Applicable
The proposed improvements situated within subject property are set back a minimum of 200' from the shoreline of

Dear Mr. Ivans:
The Southold Town Board of Trustees reviewed the survey prepared by Joseph A.
Ingegno last dated March 4, 2005 and determined the proposed construction of a
single-family dwelling, swimming pool, pool house, and retaining wall to be out of the
Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the
Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
.

.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to call.
Sincerely,

Dear Mr. King,
As you are aware, this Firm represents Mr. Giacomo F. Chicco, owner of the above
referenced property, who was erroneously issued a letter 0/ non-Jurisdiction for
improvements thereon on March .'10, 2005 in that the proposed structures would be
located outside the jurisdiction of the Board of Trustees. A copy of same is enclosed for
your reference.
During the course of regulatory review before the New York State Department of
Environmental Conservation (NYSDEC) concerning this proposal, it was discovered
that the wetlands boundary as originally delineated under the creation of the underlying
subdivision of Cove Beach Estates, approved by all required regulatory agencies,
including the Town of Southold, was incorrect. Consequently, in that the wetlands
boundary has been re-flagged and properly delineated, and in that the project has
undergone slight modifications resulting in structural setbacks within 100' from the
resultant wetlands boundary, approval from your Board is now required. Accordingly,
please find a completed Wetland Permit Application. Application contents are as
follows:
(1) Town of South old Trustees Wetlands Permit Application
(original and two [2J copies);
(2) Short Environmental Assessment Form (original and two [2J copies);
(.'I) Local Waterfront Revitalization Program Application (original and
two [2J copies);
(4) Reduced copies of the associated Subdivision Map of Cove Beach
Estates, as approved by the Town of South old on June 29, 2004, and
highlighting subject property, for reference;
.
,
(5) Location Map for easy reference (three [3J copies);
(6) Survey of subject property, prepared by JOSEPH A. INGEGNO, L.S.,
indicating all proposed structures thereon, last dated February 2, 2007
(three [3J copies); and
(7) Check made payable to the Town of South old covering the requisite
application fee.
By way of this correspondence, and on behalf of Mr. Chicco, I request that you
commence review of this application and schedule for the next available Board of
Trustees meeting for permit issuance. Anything that you may do to expedite this
matter in light of the underlying subdivision approval referenced above, would be
greatly appreciated. Should you have any questions regarding this matter, or require
additional information, please feel free to contact this office at any time. Thank you as
always for your attention and consideration.
