Y. , party of the second part, WITNESSETH,that the party of the first part,by virtue of the power and authority given in and by said last will and testament, and in consideration of twelve thousand five hundred & no/100 1� ($12, 500. 00)dollars, \� paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part X - forever, z~ ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, \! lying and being in the incorporated Village of Greenport, Town of Southold, Suffolk �` ra County and State of New York, bounded and described as follows: p xa :J_ Beginning at a point on the easterly side of Carpenter Street distant 44. 50 feet northerly as measured along the easterly side of Carpenter Street from the corner formed by the intersection of the northerly side of Ludlam Place with the east- erly side of Carpenter Street; running thence north 6°55110" west, along the easterly side of Carpenter Street, a distance of 37. 65 feet to a point and land now or formerly of N. E. L. Realty & Development Corp. ; running thence along last mentioned land, north 82°36150" east, 101.77 feet to a point and land now or formerly of Damalas & Moraitis; running thence along last mentioned land, the following two courses and distances: (1) south 14°39150" east, a distance of 27. 14 feet to a point; (2) south 76049110" west, a distance of 106. 04 feet to the - easterly side of Carpenter Street, at the point or place of beginning. BEING and intended to be the same premises of which the late Louisa T. Sherman died seized and possessed. SUBJECT to any state of facts an accurate survey might show, and to covenants, restrictions, easements, agreements, reservations, and zoning regulations of record, if any. TOGETHER with all right,title and interest, if any, of the party of the first part of, in and to anv streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also - the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. _ AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for I any other purpose. The word "party" shall be construed as if it read "parties whenever the sense of this indenture so requires.
