WITNESSETH, that the party of the first part,by virtue of the power and authority given in and by said last
will and testament, and in consideration of
(Settlement of Estate) dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,situate,
lying and being in the Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point on the easterly line of Bay Road where said easterly line
intersects the southerly boundary line of Land of the North Fork Country Club
(said point also being the northerly terminus of the said easterly line of Bay
Road); running thence along said easterly line of Bay Road, South 130 Olt 40"
West a distance of 100.00 feet; running thence along land now or formerly of
Ruth B. Case, South 76° 58' 20" East a distance of 100.00 feet; running thence
still along land now or formerly of Ruth B. Case, Noftfi-13S 01' 40" East to
land of the North Fork Country Club; running thence along said land of the North
Fork Country Club, North 89° 421 10" West to the point or place of beginning.
TOGETHER with all the right title and interest, if any, of the parties of the
first part in and to Bay Road in front of and abutting said premises, to the
center line thereof.
TOGETHER with a free and unobstructed use in common with other owners of a
Q � right-of-way for passage on foot over a certain private road two (2) rods in
width running from New Suffolk Avenue in a southerly direction to Peconic Bay;

said right-of-way being bounded on the North by New Suffolk Avenue; on the
East by land of Beverly King; on the South by Peconic Bay; and on the West
by land of the estate of George R. Case, deceased.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances,

the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered am"thing
whereby the,said premiseshavebeen encumbered in anyway whatever, except as aforesaid.
AND the pirty of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid.
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement:md will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word party' shall be construed as if it read "parties"whenever the sense of this indenture so requires.
