SMITH residing at Rural Route #2, Noxon Road, Poughkeepsie, New York party of the first part,and J GREENPORT S°-TOPPING PLAZA, a partnership with offices at Main Road, Southold, New York party of the second part, WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Incorporated Village of Greenport, Town of Southold, ~ County wof Suffolk and State of New York, bounded and described as follows:Cw7 BEGINNING at a point on the northerly side of Front Street distant 133.60 feet westerly from the intersection of the northerly " side of Front Street and the westerly side of First Street; running F THENCE south 84 degrees 33 minutes 30 seconds west along the northerly side of Front Street 90.80 feet to land of Kalbacker; a" THENCE north 5 degrees 39 minutes 40 seconds west along said land of Kalbacker 106.75 feet to other land of F. L. Barth Estate; THENCE along said other land of F. L. Barth Estate the following two (2) courses and distances; 1) In a concrete block partywall through existing building North 84 degees 12 minutes 40 seconds east 90.70 feet, and 2) South 5 degrees 44 minutes 00 seconds east 107.30 feet to the northerly side of Front Street at the point or place of BEGINNING. SUBJECT to a first mortgage in the original sum of $75,000.GO and now reduced to $73,125.00 which is held by Carl Reiter, Main Road, Southold, New York payable in monthly installments of $832.55 until June 7, 1986. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cast of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
