Foran 8002—:0MS6G—➢argam and Sale Deed,with Covenants againxt C,rzntore Acts—Individual or Corporation. k CONSULT YOUR LAWYER BEFORE SIGNING THIS INSTRUMENT-THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY THIS INDENTURE, made the 12th day of January nineteen hundred and seventy—one (�� BETWEEN SARAH BUTTO, residing at 620 Second Street, Greenport, New York 11944 party of the first part,and HENRY CARLOZZI, residing at 229 Third Street, Greenport, New York 11944 I Q 4 party of the second part, ` WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, Suffolk County, t New York, bounded as follows: BEGINNING at a point on the easterly side of Second Street where same is intersected by the southerly side of premises described herein and land now or formerly of Smith; RUNNING THENCE North 6 degress 47 minutes 00 seconds West along the easterly side of Second Street, 50.00 feet to land now or formerly of Horton; THENCE along said last mentioned land the following two (2) , courses and distances: 1. North 83 degrees 06 minutes 00 seconds East 150,05 feet; 2. South 6 degrees 48 minutes 00 seconds East 50.00 feet to land now or formerly of Smith aforementioned ; THENCE South 83 degrees 06 minutes 00 seconds West along said last .mentioned land, 150.07 feet to the easterly side of Second Street, to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by Henry Carlozzi by deed dated February 8th, 1966 and recorded in the Suffolk County Clerk' s office on July 11, 1966 in Liber 5989 of deeds at page 310. This conveyance is subject to a certain mortgage executed by Henry Carlozzi as mortgagor to Pauline Case as mortgagee, which mortgage is dated June 26th, 1962 and was recorded in the Suffolk County Clerk' s office on June 28th, 1962 in Liber 3882 of mortgages at page 585, and on which there is now due the sum of $6,000.00 with interest thereon at the rate of six percent (6%) per annum, and that the grantee hereby assumes and covenants to pay such mortgage debt and interest as part of the consideration for this conveyance. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party, of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. ,,AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- oration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for . - - any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
