Stuart and another; running thence southerly and along the easterly line of said Stuarts lot and on a course of south twenty-five degrees six minutes forty seconds west one hundred thirty-four and seven'hundredths feet to a point in the southerly line of land granted by The People of the State of New York to Sandy Beach Associa- t i on of Greenport, N. Y„ Inc. , and which grant or patent is recorded in the office of the Secretary of State of the State of New York, and also recorded in the office of the Clerk of Suffolk County, N. Y. , and which point is the southwesterly corner of the premises herein described and the southeasterly corner of said Stuart's lot; running thence in an easterly direction and along the southerlyline of said grantor patent on a course of south sixty-six degrees twenty-three minutes ten seconds east a distance of twenty-seven and ninety-four hundredths feet to a point on said patent-line distant one hundred seven and four hundredths feet westerly measured along the same from the southeasterly corner of said grant or patent, and being the southeasterly corner of the lot herein described, and the southwesterly corner of another lot now or formerly of Schmidt; running thence in a northerly direction 11BER W02 PAGE 476 and along the westerly line of said Schmidt's lot a course of north twenty-five degrees six minutes forty seconds east one hundred thirty-five and twenty-nine hundredths feet to the northeasterly corner of the lot herein described and the northwesterly corner of said Schmidt's lot on the northerly line of said right of way at the point or place of beginning. , The above mentioned bearings are according to the true north meridian. Together with the riparian rights in Greenport Harbor in front of and abutting the premises hereby conveyed. Subject, however, to easements by way of right of way over and upon the northerly 30 feet of,the,premises herein conveyed; and together with easements by way of right of way over other portions of the right of way which embraces the northerly 30 feel: of the premises of Sandy Beach Association of Greenport, T N. Y. Inc. , between the lands now or formerly of Inez Fordham on the east thereof and the lands now or formerly of Herbert Fordham on the westthereof. Also, together with a right of way, in common with others, upon over and across a parcel of land adjoining said last abo ve mentioned right of way on the" north thereof, and which parcel of land is referred to as parcel "C" in the interlocutory judgment of 1929 in the partition action in the Courty Court,; Suffolk County, entitled Archibald N. Young, Plaintiff, against Nettie E, Hall and others, defendants, which said last mentioned right of way extends north to Manhanset Avenue. These premises herein granted are conveyed subject to any and all: easements and restrictions contained in former deeds and agreements of record, ' It is further mutually understood and agreed between the parties hereto as follows: 1. That no building shall be erected upon above described premises that is obnoxious or offensive by reason of the emission of noise, odor, or gas. 2. That no part of the above described premises shall be used for public fishing, boat letting, or for duck raising, public bathing beach, or any other commercia or business enterprise, 5. That no building, including porch, shall be erected or moved on the above de- scribed premises unless the same shall be set back at least (20) twenty feet from the bulkhead or front property line of the above described premises and any building on the above premises must and shall be built, used, enjoyed and occupied only for residential purposes; except garages and garages mustnot_be used for residential purposes_ Single garages_not to exceed (9) nine feet in width and (18) eighteen feet in length. Double garages not to excee (14) fourteen feet in width and (18) eighteen feet in length. Said measurements being base line measurements. 6. That no building erected or moved upon the above described premises shall be within (3) three feet of the dividing line east or west of ownership, 7. That no building shallbe erected or moved on the above described premises with a flat roof, 8.
