Said premises being commonly known as 159 Sterling Avenue, Greenport. BEING and intended to be the same premises conveyed to the party of the first part by deed made by Peter M. Miranda, et ux, dated August 19, 1970, recorded August 24,1970, liber 6794 of conveyances, page 533. SUBJECT to (1) any state of facts an accurate survey might show; (2) covenants, restrictions, easements, agreements, reservations, and zoning regulations of record, if any; (3) rights of present tenants, if any; (4) a mortgage of record, originally in the amount of $7500 made by the party of the first part to Peter M. Miranda, et ux, dated August 19, 1970, recorded in said county clerk's office August 24, 1970, liber 5875 of mortgages, page 179, upon which there is now due and owing the principal balance of $4, 743. 28 which the party of the second part hereby agrees to assume and pay, and to that end has joined in the execution, and has acknowledged, this instrument. TOGETHER with all right,title and interest, if any, of the party of the first part of, in and to any streets NA roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said , TO HAVK AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose ofpaying the cost of the improvement and will aptly the same first to the payment of the cost of the improvement before using any part of the total of the same tor any other purpose.
