BEGINNING at a monument on the southerly line of North Parish Drive 135.0 feet easterly along said
southerly line from Dayton Road; said point of beginning being the northeasterly comer of land of Callshan
from said point of beginning running along said southerly line of North Parish Drive, -South 75 degrees 54
minutes 50 seconds East; a distance of 136.75 feet; THENCE along land of thc party of the first part, two
courses, as follows: (!) South 17 degrees 16 minutes 30 seconds West, a distance of ! 61.35 feet; THENCE
(2) North 64 degrees 57 minutes 00 seconds West, a distance of 138.55 feet to a monument and said land of
Callahan: TIIENCE along said land of Callahan. North 17 degrees 35 minutes 10 seconds East, a distance
of 135.0 feet to the point of BEGINNING.
RESERVING, however, to thc puny of the first part, her legal representatives and assigns, all rights to
installation, maintenance, repair and replacement of public utility lines, pipes, wires and conduits, along the
surface, above the sunCaco and below thc surface of the highways adjoining said premises, and the right and
privilege to enter upon the premises herein descxibed and lay, construct, erect and maintain therein or thereon

i. That only one single-family dwelling houac, for private residential purposas, and a private
garage for family use, shall be built on said premises. No trailers, tents or camping shall be
poTnitted and no occupancy o£any such dwelling house shall be permitted until thc outside and roof
shall bc fully and completely finisbed and painted.
2. That no buildings, structure or structures on, above or below the surface, other than public
utility pipes or lines, shall be erected, constructed or maintained within 35 feet ofanylanc, highway
or road.
3. That no building, structure or structures on, above or below the surface, other than public utility
pipes or lines, shall be erected, constructed or maintained within ten (10) feet ofaldelinc boundaries
and within five (5) feet of thc rear lines of said pr~nises.
4. That no building, s~ructuro or structures shall be erected, constructed or maintained at a height
in",~;~coss of two stories. Buildings shall bo erected on closed foundations of poured concrete or
cohO'fete blocks, and no buildings on posts shall be permitted.
5. That no dwelling house, exclusive of garage, shall be erected on said premises which shall
contain less than 1,000 square feet on the ground floor, cxclusive ofporchcs and garages. All plans
and specifications shall be subject to the approval of thc party oftha list part, in writing but such
approval shall not be unreesonably withheld.
6. No nuisances and noises of any kind, unwholesome and offensive to thc neighborhood, shall
be permitted to exist on said premises, nor shall nay accumulation of rubbish, garbog=, junk or
materials of any kind be permitted to remain on said premises. No advcrtising signs, billboards or
other sign devices shall be permitted on said premises, excepting a devalopcr's sign or a "FOR
SALE" and "FOR RENT" sign of reasonable dimensions. Owners shall cut thc grass and keep thc
appearance of thc premises in accordance with thc standard of thc community. No hedge or fcncc
shall bc allowed to be constructed over five (5} feet in height.
7. No fowl, poultry, animals or livestock shall b¢ kept on said promises, except domestic
household pets.
8. There shall bc no outside tuilcts or outhouses erected upon said premises. An adequate septic
tank or cesspool shall be erected and maintained to take cam of thc sewage disposal.
9. Said premises shall be subject to electric, alcetric light, gas and telephone easements on the
surfaco or below the surfucc and above thc surface along thc roadway or lane adjacent to said
premises.
! 0. No sand, earth or sod shall be,umoved firom thc pramises, or excavation be allowed to remain
open thereon, except as may be necessary at such times es building or landscaping operations arc in
progress.
I 1. The said covenants and restrictions arc hereby declared to be covenants and restrictions
at~uchcd to and running with the land. That such covenants and restrictions arc to run for a period
