TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby thersaidremises have been incumbered in any way whatever, except as aforesaid.
AND the party ofPthe first part, in compliance with Sectien 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word 'party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

-,ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being at Mattituck, Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:
BEGINNING at a point in the southeasterly corner of the premises
about to be described, distant the following two (2) courses and
distances from a monument set for a bound in the northerly side
of Oregon Road marking the southwest corner of the land now or
formerly, of Sarah M. Garvey and the southeasterly corner of the
land now or formerly of William A. Herman, said monument being
approximately 1/4 mile west of Duck Pond Road:
1) South 49 degrees 10 minutes 20 seconds West, 263 . 90 feet;
2) North 37 degrees 04 minutes 10 seconds West, 3222 .28 feet to
said point of beginning;
RUNNING THENCE South 54 degrees 57 minutes 00 seconds West,
561. 01 feet to a monument and land now or formerly of A.
Bonkoski;
RUNNING THENCE northerly along said land now or formerly of
Bonkoski, North 34 degrees 37 minutes 00 seconds West, 798 feet
to the ordinary high water mark of the Long Island Sound;
THENCE along the ordinary high water mark of the Long Island
Sound, bearing North 64 degrees 15 minutes 30 seconds East,
506.45 feet to a point and land now or formerly of William
Herman;
THENCE along said land now or formerly of Herman, South 37
degrees 04 minutes 10 seconds East, 751 feet to the point or
place of BEGINNING.
BEING AND INTENDED TO BE a part of the same premises conveyed to
the party of the first part by deed dated January 15, 1990 and
recorded in the Office of the Clerk of the County of Suffolk on
January 18, 1990 in Liber 11001 of conveyances at page 569.
This conveyances, together with a conveyance made by Josephine
Zanieski on April 20, 1988 and on January 23 , 1989 and the
parties of the first part and Josephine Zanieski on January 15,
1990 to the parties of the second part, constitutes ownership of
the property as follows:
ALEXANDER ZANIESKI, JR. , residing at (no #) Bennett's Pond Lane,
Mattituck, New York 11952, as to a 25% interest; ANTHONY
ZANIESKI, residing at (no #) Oregon Road, Cutchogue, New York
11935, as to a 25% interest; FRANCES J. STELZER, residing at (no
#) Mary's Road, Mattituck, New York 11952, as to a 25% interest;
and DOROTHY SMITH, residing at 99 Daly Court, Riverhead, New York
11901, as to a 25% interest, all as tenants in common without
right of survivorship.
