THIS INDENTURE, made the day of December, Nineteen Hundred
and Ninety Five,
BETWEEN MARION SMITH, residing at 103 East Caroline Street,
TavaRes, Florida 32778
party of the first part, and
MARION ELIZABETH SMITH, residing at 103 East Caroline
Street, TavaRes, Florida 32778, as Trustee of the MARION
ELIZABETH SMITH FAMILY TRUST, dated May 16, 1995
party of the second part,
WITNESSETH, that the party of the first part, in consideration
of ten dollars and other valuable consideration paid by the second
part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land situate in the
Village of Mattituck, County of Suffolk and State of New York,
described as follows:
BEGINNING at a point on Laurel Lake which point is the western
boundary of the land of' Marion Smith;
THENCE in a westerly direction along the shore of Laurel Lake a
distance of 50 feet;

THENCE in a northeasterly direction of about 392 feet more or less
to a road known as Laurel Way;
'-1 THENCE in a southeasterly direction along the southerly side of
,0 Laurel Way a dtsiance of about 65 feet more or less to land of
Marion Smith;

THENCE in a southwesterly direction along the northwesterly
J boundary of land of Marion Smith a distance of about 260 feet more
or less to the point or place of BEGINNING on Laurel Lake.
SUBJECT to any state of facts which an accurate survey might show.
SUBJECT to covenants, restrictions, reservations, easements, and
agreements of record affecting the foregoing described premises.
SUBJECT to zoning restrictions and ordinances adopted by any
municipality, town, village or other governmental authority.
BEING AND INTENDED TO BE the same premises conveyed to the grantor
by deed dated August 31, 1945 and recorded in the Suffolk County
Clerk's Office on October 22, 1945 in Deed 2496, page 593.
The above premises is not encumbered by a credit line mortgage.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with
the appurtenances and all the estate and rights of the party of the
first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the
heirs or successors and assigns, of the party of the second part
forever.
AND the party of the first part covenants that the party of the
