(631) 765-1809 • Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 9, 2006 ZB File No. 5934 - NICHOLAS and HARRIET ZANNIKOS Property Location: 505 Sound Beach Drive, Mattituck CTM 99-1-22 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' proposed is referred to as Lot 18 on the Map of Captain Kidd Estates (filed in 1949 with the Suffolk County Clerk), and contains a total area of 7,500 square feet, with 50 feet along Sound Beach Drive. BASIS OF APPLICATION: Based on the Building Inspector's May 23, 2006 Notice of Disapproval under Section 100-244 (280-124), a variance is requested for an as -built accessory shed which increases the total lot coverage over the code limitation of 20%, and which shed was not requested under variance issued under #5174 dated 6/9/2005. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants are requesting relief from the lot coverage provision of the Zoning code to allow an 8.4 ft. by 13 ft. accessory frame shed. The requested lot coverage will total 21.4%, and is shown on the site plan prepared by the applicant on a survey by Jack Allison Hall). The location of the as -built new shed is sited with its size and detailed location on an updated survey dated August 16, 2006 prepared by Joseph A. Ingegno. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The as -built accessory shed is in a location Page 2 — November 9, 2006 ZB File No. 5934 — N. Zannikos CTM No. 99-1-22 similar to the location of a former shed, now removed. This as -built shed is not visible from the street or adjacent properties and is in keeping with the architectural styles in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance since the as -built shed increases the lot coverage on the subject property beyond the allowed 20 percent. A 1 3. The variance granted herein is not substantial since the proposed increase of lot coverage is 1.4% (or 107 sq. ft.) beyond the code required maximum of 20 percent of the lot size, for a total of 21.4%. 4. The alleged difficulty has been self-created because the size of the owner/applicants' new dwelling and shed exceeds the allowable lot coverage and a variance should have been applied for in the original application for relief. However the need for an accessory shed is the result of building on a residential lot that is within a flood plain and thereby restricted in terms of below -grade storage. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new accessory storage shed, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairwoman Oliva, and duly carried to GRANT the variance as applied for, as shown on the August 16, 2006 survey prepared by Joseph A. Ingegno and shown on the Hall survey map with lot coverage breakdown data prepared by the applicants' architect. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. PROPERTY FACTS/DESCRIPTION: The applicant's 7,500 sq. ft. parcel has 50 feet along South Beach Drive, and is improved with a one-story, single-family home and accessory shed. BASIS OF APPLICATION: Building Department's April 6, 2005 Notice of Disapproval, amended April 14, 2005, citing Sections 100-242A and 100-244, in its denial of an application for a building permit to construct. The reason stated in disapproving the building permit application is the new construction (additions with alterations) will constitute an increase in the degree of nonconformance, proposed at less than 10 feet on a single side yard, less than 25 feet total side yards, less than 35 feet on the front yard, and the total lot coverage will exceed the code limitation of 20%. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct 6' x 37' first -floor and second -floor deck additions, 38' x 27' second -floor addition, with alterations to the existing home, and an 24' x 16' two-story addition at the rear of the home. The applicant also proposes to remove a shed existing in the rear yard with the variance request. RELIEF MODIFICATION: During the June 2, 2005 hearing, the applicant was requested to consider a single -story rear addition instead of a two-story construction, and the applicant agreed, modifying his request for a single -story new addition at the rear of the dwelling. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2 — June 9, 2005 ZB Ref. 5714 - Nicholas Zannikos & ors. CTM ID: 99-1-22 1. The character of the neighborhood will not be affected by the requested variances, as modified and discussed at the June 2, 2005 public hearing with the applicant. The front addition is for open two-story deck area with the upper level open to the sky (without a roof). The second -story addition at the front is proposed over the existing first floor area of the applicant's home is proposed to meet the code required 35 ft. front yard, and the side yards will maintain the existing nonconforming setbacks at 6 feet on each side at its closest measurements, and 10.5 feet and 15.5 feet for the rear two story addition. The new construction will be utilizing a major portion of the property which has already been developed, and which is the most economic and efficient manner for the applicant in expanding living space without covering a large percentage of the lot. 2. The amount of front yard setback relief is for a reduction of two feet from the code requirement, in permitting the addition of a 6—foot covered (two-story deck construction) at 33 feet, instead of the code required 35 feet. 3. The amount of lot coverage relief requested for the new additions provides for a lot coverage of 21.4 per cent, which is not substantial. The applicant is removing the shed existing in the rear yard, and adjusts for allowance resulting in the requested 1.4% increase over the code limitation of 20% lot coverage for the proposed front yard two- story deck and rear addition. The applicant is also reducing the elevation of the rear addition to one-story instead of two-story, based on the conditions of the nearby bluff area which did not appear to be completely stabilized. 4. The increase in the degree of nonconformity with respect to the existing non- conforming side yard setbacks will not be substantial, as there will be no change in the established setbacks. 5. The additions, with modification to the rear addition for one-story construction instead of two-story, will provide substantial benefits to the owner, without impact or change affecting the immediate site area. 6. Grant of the variance relief is the minimum action necessary adequate to enable the applicant to enjoy the benefit of his property while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
