-' WITNESSETH,that the party of the first part,in consideration of

lawful money of the United States, and other good and valuable consideration paid -
by the party of the second part,does hereby remise,relerse and quitclaim note the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
ALL that tract or parcel of land situate, lying and being at
Southold, in the Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:-
BEGINAiING at a point on the Southerly line of a proposed -
- highway 50 feet in width (which point is the northwesterly corner of
the promises heroin described, and xhich point is South 77 degrees
46 minutes 50 seconds East a distance of 300.0 feet from the north-
easterly corner of premises heretofore conveyed by Raymond W. Terry
at al. to Ellie M. Terry and wife by deed dated February 16, 1957,
and recorded in Suffolk County Clerk's Office on March 1, 1957, in
Libor 4266 of Deeds at page 265); running thence in an easterly
direction along said southerly line of said proposed highway South `
77 degrees 46 minutes 50 seconds East a distance of 100.0 feet;
running thence along other land of the parties of too first part on
a line at right angles to said southerly line of said proposed high'-
way, South 12 degrees 13 minutes 10 seconds West a distance of 152
feet, more or less, to ordinary high water mark of Jockey Creek;
running thence in a westerly direction along said ordinary high
_- water mark of Jockoy Crook a distance of 100 foot, or moro, to a
point which is South 12 degrees 13 minutes 10 seconds West from the
- point or place of beginning; running thence North 12 degrees
13 minutes 10 seconds East a distance of 1148 feet, more, or less, to
the point or place of beginning.
TOGETHER with the right to the ueo of a right of way (in common
with others) over said 50 foot proposedhighwayfrom the north-
easterly corner of the promises and extending westerly a distance of k
about 715 feet to the Main Road, for the purpose of ingress and _
ogress to and from the promises above described and to and from
Main Road, and for the purpose of installation, maintenance,---ropair `
and replacement of public utilities on the surface, above-tho surface
and below the surface of said right of way.

acceptance of this dead, do hereby consent to such dedication and -
do heriby release the said Town of.Southold from aay liability for -
damages oecasibned by reason of said dedication and acceptance of =
said right-of way as a public highway.

the parties,of the firstpart im,hhd to the' gutter, meadow, waters
and lands under water of Jockey Crook in front of and abutting
said pronisoe on the south to the center line thereof. -
SUBJECT to the following covonsnts and restrictions:
1. No building or other structure shall be erected or maintained
within. 15 feet of either side line of the p:emisos above described.-
2. Said promisor shall be used solely forresidentialpurposes.
_ 3. The aforesaid covenants and restrictions shall cease and
expire on January 1, 1978.
This deed is given to correct the description contained in
a certain deed dated March 28t 1957, records'& in Suffolk County - -
Clerk-s office on June 5, 1951, in Libor 4310 of Deeds, at Page 236.
