o WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
�I or successors and assigns of the party of the second part forever,

ALL that tract or parcel of land situate at Horton's Point, in Southold, Town of
Southold, Suffolk County, New York, bounded and described as follows:-
BEGINNING at a point on the northerly side of Hurricane Lane, a private road,
m a 232.66 feet west of the Bomnment at the Northwest corner of the intersection of
w W Hurricane Lane; a private road, and Hortonts Lane, and running thence In a south-
westerly direction along the edge of the Northerly side of the said Hurricane Lane,
a private road, 40 feet, more or less; thence turning at a right angle and running
In a northwesterly direction 200 feet, more or less, to the ordinary high water mark
of Long Island Sound; thence turning at a right angle and running in a northwesterly
direction along the ordinary high water mark of Long Island Sound, and parallel with
the aforementioned southerly boundary along Hurricane Lane, a private road, 40 feet,
more or less; and thence turning at a right angle and running in a southeasterly CU-
rection along the southwesterly side of land now of Sara L. Hyatt, and parallel with
the aforementioned southwesterly side of the premises herein described, 200 feet ,
more or less, to the point or placer of beginning.
TOGETHER with all right, title and interest of the party of the first part of, in and
j to the beach and lands under water of Long Island Sound in front of and adjacent to
said premises.
TOGETHER with a right of way over land of Sara L. Hyatt adjoining said premises on
the south, being a strip of land 25 feet in width constituting a private way known as
Hurricane Lane, for passage on foot and with vehicles to Hortonts Lane on the east.

Being and intended to be the same premises conveyed by Sara L. Hyatt to 'Mae Halbauer
by deed dated Nay 9th, 1941, and recorded in the Suffolk County Clerk's Office on hfay
12, 1941, in Liber 2161 of deeds at page 598 and subject to the covenants and restric
ions therein contained.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
j the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for

„ lAND the party of the first part covenants as follows: that said party of the first part is seized of the said
