Box 9398 Riverhead, New York 11901 RE: EVE MACSWEENEY AND LORI FEILEN 1205 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 50-2-13 Dear Ms. Dalli: The Board of Town Trustees took the following action during its regular meeting held on Wednesday February 14, 2007 regarding the above matter: WHEREAS, Twomey, Latham, Shea, Kelley, Dubin, Reale, and Quartararo as agent for EVE MACSWEENEY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 17, 2007 and WHEREAS, said application was referred to the South old Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 14, 2007 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, 2 . . WHEREAS, in accordance with Chapter 268, said application was found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of EVE MACSWEENEY AND LORI FEILEN to replace and install new hardwood floor boards, stair treads and railings to first and second floor decks, and all as depicted on the plan prepared by R. Barratt PE approved 2/14/07 by the Southold Board of Trustees and the survey prepared by Stanley J. Isaksen, Jr. dated June 11, 2005. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) TERMS AND CONDITIONS The Permittee, Eve MacSweeney and Lori Feilen, 1205 Soundview Ave, Southold, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of South old are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions ofthe originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no umeasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That iffuture operations of the Town of South old require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to tree navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. < . James F. Yes. Project is for replacement and installation of new hardwood floor boards, stair treads and railings to first and second floor decks. The project will not in any way change the character of the neighborhood or affect any historic or cultural center. The project will have no impact on the economic base of the community. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. Yes. There are no known historic or archeological conditions on the subject site. Project is for the replacement and installation of new hardwood floor boards, stair treads and railings to first and second floor decks and in no way will affect any historic or significant archeological sites in close proximity to the subject premises. Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. Yes. Project is for the replacement and installation of new hardwood floor boards, stair treads and railings to first and second floor decks. There is no construction proposed outside of the existing footprint of the subject dwelling. There will be no excavation of any materials from the land. Applicant satisfactorily obtained Board of Trustees approval for the re-vegetation of the bluff at the subject premises pursuant to Permit Number 6472 which passed inspection on January 4, 2007, thereby improving the quality of scenic vegetation, while preserving the existing vegetation, which will contribute to the scenic quality of the landscape. There will be no clearing of any existing vegetation at the site. Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. Yes. There will be no hard erosion control structures constructed at the premises. Applicant satisfactorily obtained Board of Trustees approval for the re-vegetation of bluff at the subject premises pursuant to Permit Number 6472, which passed inspection on January 4, 2007, thereby increasing the protective quality of the existing natural features of the bluff. Policy 5. Protect and improve water quality and supply in the Town of Southold. . . Yes. Project will maintain existing vegetation, thereby providing soil stabilization. Location of first and second floor decks remain within the original footprint, thereby maintaining natural surface water flow characteristics presently at the site. Water quality will be protected from any adverse impacts inasmuch as no excavation is contemplated and there will be no fill placed at the site. All materials will remain on site. Policy 6. Protect and reston, the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. Yes. There is no proposed eXI,avation at the site or the introduction of fill. Project is for the replacement and installation of new hardwood floor boards, stair treads and railings to the first and second floor decks. All existing fill to remain on site in present location. Existing vegetation to remain and there will be no disturbance to existing vegetation. There will be no adverse impacts on existing natural habitats on the site or destruction of existing wildlife. There will be no anticipated subsurface water flow change at the site, thereby avoiding any adverse effects a change of water flow may have on existing wildlife habitats. Policy 7. Protect and improve air quality in the Town of Southold. Yes. The proposed construction will not in anyway generate air pollution at the subject site. There will be no sources of air pollution introduced at the site. No vehicles or equipment will be used during the construction phase, which will generate air pollution. No outdoor contaminants will be produced as a result of the construction. Policy 8. Minimize environmental degradation in Town of Southold from solid waste and hazardous substances and wastes. Yes. No sources of contamination will be introduced during the construction phase, thereby protecting the coastal resources. No hazardous waste or landfill will be placed at the site. Any solid waste generated as a result of the construction will be removed from the site. Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Yes. Physical blockage due to proposed construction of existing visual access will be limited and visual access will be protected from the Long Island Sound. Construction design will not have an impact on obstruction of public views since construction is for the replacement and installation of new hardwood floor boards, stair treads and railings to first and second floor decks. Public access can be gained at Lighthouse Road, approximately 1,220 feet westerly of subject premises. Visual access will be protected at the shoreline from the water, whereby no land clearing is proposed and existing vegetation will be protected. Construction will not impair publ ic access along Long Island Sound or along shoreline. There will be no adverse effect on the natural environment. . . Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations. Yes.
