Dear Ms. Dalli:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 21, 2007 regarding the above matter:
WHEREAS, Twomey, Latham, Shea, Kelley, Dubin, Reale & Quartararo, LLP on behalf
of EVE MACSWEENEY applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated September 21,2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their find.ings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 21,2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of EVE
MACSWEENEY to construct a 4'x160' access stairway with (2) 4'x4' platforms and (5)
4'x4' platforms; construct removable 8' section at toe of bluff. Stairway to maintain 3.5'
above grade. Existing vegetation will be protected and new vegetation will be planted
along length of stairway, and any trees that are removed should be cut at the base with
the stumps to remain, with the condition of a row of staked hay bales along the top of
bluff, and no CCA treated lumber used on handrails, and as depicted on the plans
prepared by Robert O. Barratt, last dated 02/23/07.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

TERMS AND CONDITIONS
The Permittee Eve MacSweenev. residing at 1250 Soundview Avenue. Southold. NY, as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes ful' liability with respect thereto, to the complete exclusion of the Board of
Trustees ofthe Town of Southold.
2. That this Petmit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. Thai this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That iffuture operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The following action was taken by the Board ofToWD Trustees during a Regular Meeting, held
on May 24,2001, regarding the above matter.
WHEREAS, SUSAN E. LONG, PERMITS on behalf ofSARAU L. CAMPBELL applied to
the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of South old, application dated May I, 2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 24, 2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustee approved the application of SUSAN E.
LONG,PERMITS on behalf of SARAH L. CAMPBELL for a Wetland Permit to construct
185' +/- access stairway with 4'x5' upper middle and lower platform and 3 'x8' removable stairs
with two conditions that the trees that need to be cut be cut at ground level and stumps remain
and any vegetation has to be cleared is just cut and allowed to re-grow for bluff stabilization.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar proj eet.
Permit to construct project will expire two years from the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date of this notification.

EVE MACSWEENEY requests a Wetland Permit to construct 4'X 160' access stairway
with (2) 4'X 6' platforms and (5) 4'X 4' platforms. Construct removable 8' section at toe
of bluff. Stairway to maintain 3.5' above grade. Existing vegetation will be protected and
new vegetation will be planted along length of stairway. Located: 1250 Soundview Ave.,
Southold. SCTM#50-2-13
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
L WRP provided that the following Best Management Practices are applied to
further the policies:
1. No CCA is used in the construction ofthe handrails.
2. A revegetation plan is provided for the blufffollowing
construction to control erosion.
3. Existing vegetation on the blnff is protected during construction
and the applicant limits the clearing of vegetation to the area
necessary to constrnct the access stairway. Any trees that are
removed should be cut at the base with the stumps to remain.
Pursuant to Chapter 268 the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

assessment is intended to supplement other information used by a Town of SOllthold agency in

infrastructures, makes beneficial use of a coastal location, and minimizes
adverse effects of development.
Yes. Project is for construction of an access stairway approximately 160' in length,
by 4' wide, with upper, middle and lower platforms. Proposed location of stairway is
to follow natural contours of the bluff down to the existing sand/stone beach, thereby
minimizing any adverse effect of development along the bluff. All construction to be
completed by hand and there will be no excavation of any materials at the site. The
project will not in any way change the character of the neighborhood or effect any
historic or cultural center. The project will have no impact the economic base of the
community.
Policy 2. Protect and prcserve historic and archaeological resources of the Town
of Southold.
Yes. There are no known historic or archeological conditions on the subject site.
Proposed project is for new construction of an access stairway leading to the Long
Island Sound and in no way will effect any historic or significant archeological sites
in close proximity to the subject premises.
Policy 3. Enhance visual quality and protect scenic resources throughout the
Town of Southold.
Yes. Applicant proposes to construct an access stairway along the natural contours of
the bluff, approximately 160' in length down to the sand/stone beach. There will be
no construction on the sand/stone beach which varies in width between 60 and 80 feet
to the average high water mark. There will be no excavation of any materials from
the land and applicant proposes to construct the access stairway by hand. Applicant
proposes to establish new vegetation along the length of the stairway thereby
improving the quality of scenic vegetation. while preserving the existing vegetation,
which will contribute to the scenic quality of the landscape. There will be no clearing
of any existing vegetation at the site.
Policy 4. Minimize loss of life, structures, and natural resources from flooding
and erosion.
Yes. There will be no hard erosion control structures constructed at the premises with
the exception of establishing new vegetation along the length of the stairway.
Applicant will use vegetative non-structural measures to increase the protective
quality of the existing natural features. There will be no clearing of existing
vegetation and new vegetation will be planted along the entire length of the stairway,

thereby increasing the natural protective qualities of the bluff. Proposed stairway
will provide access to the beach, thereby preventing pedestrian damage to the existing
and enhanced dunes.
Policy 5. Protect and improve water quality and supply in the Town of
Southold.
Yes. Project will maintain existing vegetation and will establish new vegetation along
the length of the access stairway, thereby providing soil stabilization. Proposed
location of stairway will follow natural contours of bluff, thereby maintaining natural
surface water flow characteristics presently at the site. Water quality will be
protected from any adverse impacts inasmuch as no excavation is contemplated and
there will be no fill placed at the site. All materials will remain on site.
Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystems including Significant Coastal Fish and Wildlife Habitats and
wetlands.
Yes. There is no proposed excavation at the site for the introduction of fill.
Applicant proposes to construct stairway by hand and placing 4' x 4' posts
approximately 3' in depth in the ground. All existing fill to remain on site in present
location. Existing vegetation to remain and any disturbance to existing vegetation
will be restored, along with introducing new plantings along the entire length of the
project. Accessing stairway, rather than utilizing pedestrian travel, will avoid any
adverse impacts on existing natural habitats along the bluff, minimizing destruction of
existing wildlife. There will be no anticipated subsurface water flow change at the
site, thereby avoiding any adverse effects a change of water flow may have on
existing wildlife habitats.
Polic)' 7. Protect and improve air quality in the Town of Southold.
Yes. The proposed construction will not in anyway generate air pollution at the
subject site. There will be no sources of air pollution introduced at the site. No
vehicles or equipment will be used during the construction phase of the stairway
which will generate air pollution. No outdoor contaminants will be produced as a
result of the construction of the stairway.
Policy 8. Minimize environmental degradation in Town of Southold from solid
waste and hazardous substances and wastes.
Yes. No sources of contamination will be introduced during the construction phase,
thereby protecting the coastal resources. No hazardous waste or landfill will be
placed at the site. Any solid waste generated as a result of the construction will be
removed from the site.
Policy 9. Provide for public access to, and recreational use of, coastal waters,
public lands, and public resources of the Town of Southold.
Yes. Physical blockage due to proposed construction of existing visual access will
be limited and visual access will be protected from the Long Island Sound.
Construction design will have minimal impact on obstruction of public views.

gained at Lighthouse Road, approximately 1,220 feet westerly of subject premises.

This office represents Eve MacSweeney, owner of the above referenced premises
for which we are making application for the proposed construction of an access stairway
to the beach. The previous owner, Sarah L. Campbell, obtained Board of Trustee and
New York State Department of Environmental Conservation approval in 2001 for almost
identical construction of a 4' x 185' access stairway in approximately the same location.
