ADDENDUM TO PERMIT # 6354
Wetland Permit to remove 62' of existing west bulkhead; construct 435' of new bulkhead
immediately in front of existing bulkhead using vinyl sheathing. Remove 65' of east and
north bulkhead sections and replace in place using vinyl sheathing. Repair 30' of existing
stone north bulkhead in-place. Relocate existing concrete blocks above spring high
water line. Maintenance dredge existing basin to a depth of --4.0' below mean low water
(approx. 1650-2000 cy.). Deposit spoil (sand) as beach nourishment on southwest side
of inlet between high water and high marsh area, with the condition that the area
landward of the bulkhead remains non-turf, no CCA treated lumber used in the
sheathing, and all as depicted on the plans prepared by Costello Marine Contracting
Corp. last dated Nov.11, 2005.

Dear Mr. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 19, 2006 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. as agent for ANN MARIE NELSON
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the South old Town Code, the Wetland Ordinance of the Town of Southold,
application dated December 8, 2005 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 19, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of ANN MARIE NELSON
to remove 62' of existing west bulkhead; construct 435' of new bulkhead immediately in front of
existing bulkhead using vinyl sheathing. Remove 65' of east and north bulkhead sections and
replace in place using vinyl sheathing. Repair 30' of existing stone north bulkhead in-place.

Dear Board of Trustees,
This letter is in follow up to a recent conversation with Heather Cusack about information CCE has relative to pollution
issues in the drainage area near Silvermere Road in Greenport.
A water sample was collected by CCE on 9/27/04 from the drainage ditch on the east side ofSilvermere Road at the
intersection of Silver Lane. Fecal coliform levels in this sample were very high at 5800 cfu/lOOml. We also ran water
chemistry on this sample and have the following results:
Nitrate (NO,) 0.2 mgIL
Phosphorus (PO.) 0.155 mgIL
Ammonium (NH,N) 5.9 mgIL
CWoride (Cl) 3901 mgIL
The nitrate and phosphorus levels are very low. The ammonium level is somewhat elevated and is consistent with
wastewater levels. The chloride level is very high and is likely an indication of hypo cWo rite (household bleach), a
constituent of domestic wastewater.
We also ran this sample through a fluorometer with a filter sensitive to the fluorescent wavelengths associated with optical
brighteners found in laundry detergents. The results were 199 PPB. A result greater than 100 PPB. is a significant indication
that the source of the fluorescence is likely to be an optical brightener from a cleaning agent such as laundry detergent. .
Again this is an indication of domestic wastewater. .
Cornell Cooperative Extension also has a DNA laboratory where we are able to use DNA profiling of coliform bacteria to
identify the animal source of these bacteria in water samples. We can identify the source to many common animals such as
humans, dogs, raccoons, Canada geese and a list of other common wildlife and waterfowl. Due to lack of funds, we did not
run the above sample through our DNA lab. However we did extract and save 20 bacterial isolates from this sample and
have them stored in the lab where they can be re-grown and run in the DNA lab if funds become available.
Also, on 9/30/04 the Office of Ecology, Suffolk County Department of Health Services, collected 3 water samples, one from
each of the culverts on the east and west sides of the intersection of Silvermere Road and Silver Lane. From each of those
samples, CCE saved 20 bacterial isolates which are stored in the CCE lab. These isolates were not run for DNA but can be
re-grown and analyzed. Contact the Office of Ecology for the results of their analysis of the water samples.

At the meeting of the Southold Town Conservation Advisory Council held Wed.,
November 9, 2005, the following recommendation was made:
Moved by Doris McGreevy, seconded by Jack McGreevy, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit appliation of ANN MARIE NELSON to construct 570'+/- of new
bulkhead immediately in front of and within 18" of existing bulkhead. Remove 30'+/- of
existing bulkhead and replace in-place with new bulkhead.
Located: 1420 Ninth St., Greenport. SCTM#45-6-9.4

Thank you for your recent correspondence to ROQ~rtW aters and I concerning the'
drainage pipes on Silvermere Road, Greenport ana their potential impact on the
adjacent marshland that is closed to shellfishing. As you are aware, the Suffolk
County Department of Health Services (SCDHS) and the New York State
Department of Environmental Conservation (NYSDEC) have investigated this
situation on a number of occasions. Numerous water quality samples have been
collected by both agencies and a number of dye-tests performed on nearby
residential septic systems.
There are two drainage pipes exiting the bank on the east side of Silvermere Road,
south of Silver Lane. The general area is characterized as having a high water
table and clayey soils. According to Daniel Lewis of the NYSDEC the
southernmost (metal) pipe is directly connected the adjacent street storm drain on
__ the west side of Silvermere Road. The drainage area of the northern (clay) pipe is
unknown. The water quality sampling results as shown on the enclosed data table
indicate consistently elevated levels of fecal bacteria in the north discharge (clay
pipe), however, dye-tests performed on the sewage disposal systems of area
residences have also been consistently negative.
As elevated coliform counts may be attributed to sources other than domestic
wastewater (e.g., wildlife), and no direct evidence of an illicit sewage discharge
has been identified, it is inaccurate to describe the discharge as sewage effluent.

This situation is not an uncommon occurrence, particularly when the flow is either
minimal or indirect, and soils are poorly drained as with the subsurface clay layers
involved in this case. It is possible that the septic systems are functioning as
designed, but due to the high groundwater level and poor soils, contaminants are
being dispersed and intermingled to the surrounding groundwater. A close
examination of the data suggests in fact, that any connection is likely indirect.
The fecal coliform levels detected in the monitoring, although elevated, are
generally much lower than total coliform levels. Were there a direct connection or
catastrophic failure of a nearby septic system, fecal levels would likely be as high
as total levels. Due to the small flows involved, the discharges are considered
relatively minor sources of contamination when viewed in the context of the entire
marsh. However, this is not to say that it is not good practice for the discharges to
be redirected or eliminated. The most obvious suggestion, as the pipes in question
are within a town road and discharge to a town regulated wetland, is to give
consideration to having the highway department remove or redirect the pipes.
There may be grant funding available to assist the town through the NYS
Nonagricultural Nonpoint Source Abatement and Control Program grants. Local
municipalities are eligible to apply; the highest funding priority is placed on
stormwater mitigation and s~ptic system management._ More information is

It is readily apparent that correcting the pipe discharge to the marsh will not in
and of itself correct the larger problem of the closure of Silvermere marsh to
shellfishing by the DEC (map of shellfish closure area attached). As evidenced by
the enclosed aerial photographs, the major cause of the closure is likely the lack of
tidal flushing since the narrow bulkheaded inlet to the marsh is nearly shoaled
over. It is highly probable that significant amounts of coliform contamination are
continually contributed to the marsh by local wildlife, including raccoons,
muskrat and waterfowl. The restriction of tidal flow into the inlet severely
inhibits the flushing action that would help reduce contamination trapped in the
marsh. Although dredging the mouth of the creek would undoubtedly improve
the water quality, it still may not be sufficient to reopen the creek to shellfishing.
It should be noted, that water quality in Pipes Cove is not similarly impacted
because it is a highly flushed waterbody. The office routinely sampled the beach
at the Silver Sands Motel in the summer of 2005, and found levels of enterococci
bacteria to be either very low or undetectable.
At this time, the Office of Ecology does not plan to conduct additional monitoring
of the site as no direct evidence of an illicit discharge has been identified by prior

As a follow-up to our Resolution dated April 19, 2006, the Board of Trustees approved the
application with a stipulation that the permit would not be released until we received proof
that the pipes on Silvermere Rd. were closed.
The stipulation that was articulated is no longer required and the permit can be released
without proof of the pipes being closed.

application -- by the way, it was found consistent with the
LWRP and CAC recommended approval. They had one condition,
recommended approval with the condition dry well is
installed to contain the pool backwash, and all trees with a
diameter of six inches or more from the hay bale line to the
water are left in place. From the hay bale line to the
water, if I remember right that was like a nondisturbance
area.
. MR. SAMUELS: It could be. It doesn't show up on the
paperwork we have. We're treating it as a nondisturbance.

with the dry well for backwash for the pool, and I don't
know how many feet of fence you would remove there, probably
25-30 feet or so. Remove the old existing chain link fence
that's into the wetlands, remove it back to the toe of the
bluff

12. Costello Marine Contracting Corp. on behalf of
ANN MARIE NELSON requests a Wetland Permit to remove 62' of
existing west bulkhead, construct 435' of new bulkhead
immediately in front of and within 18" of existing bulkhead
using vinyl sheathing. Remove 65' of east and north
bulkhead sections and replace in-kind/in-pJace using vinyl
sheathing. Repair 30' of existing stone north bulkhead
in-place. Relocate existing concrete blocks above spring
high water line. Maintenance dredge existing basin to a
depth of minus 4' below mean low water, appro1(imately
1650-2000 cubic yards. Deposit spoil (sand) as beach
nourishment on southwest side of the inlet between high
water and high marsh area.

MR. COSTELLO: I've spoken on this many times and I believe
the last discussions at the last meeting were if we could
get an approval on it with any contingencies the Board so
desires because there were some environmental concerns,
legitimate environmental concerns of sewerage being pumped
into the wetlands area, and I think if those restrictions
would allow that before the project couid be done, so be
it. I think it would be a wise decision on the Board's
part, and I would hope some of the powers to be, this Board,
the Police Department, the Health Department, the DEC and

the Highway Department of Southold could resolve that
problem in some time frame, and by placing the sand as beach
nourishment to the west, I think you'll also assist as just
a natural bypass to what is occurring now.
TRUSTEE DOHERTY: When you say you're going to place to the
west?
MR. COSTELLO: To the west side, it's just a bypass of sand;
the east side has too much sand, the west side has too
little.
TRUSTEE HOLZAPFEL: Is there anybody else who wishes to
speak? Just for your information, earlier tonight I think
just during the work session or before, I'm not sure, I
don't think you were here. At the time we spoke and said
that Jill had been in contact with DEC in the sense of
controlling the sewerage that's coming from up above, and
they're trying to get the police involved and the DEC and
make some headway in that. We didn't want to close off the
pipe at this point because if there is a problem that water
would be coming onto Town property, and we can in turn use
the Town as an agent to close that off. But it's the
intention of the Board, I think, to move ahead with the idea
that there will be an application approved if that pipe is
closed.
MR. COSTELLO: And 1 think any Board Member wants to go down
on there on a rainy day, you'll know what the problem is.
TRUSTEE HOLZAPFEL: Even dry weather they were saying it's
flowing right through now.
MR. COSTELLO: And that is a violation on somebody's
part. And again, Mrs. Duffy is here and to put the sand on
the west side, we certainly would need her approval because
that is the property that a majority of the fill would be
placed on.

MR. COSTELLO: I think it's in the file. I hope it is.

13. Costello Marine Contracting Corp. on behalf of
BREEZY SHORES COMMUNITY, INC. C/O HELEN SZARKA requests a
Wetland Permit to remove and replace in-kind/in-place eight
existing jetties, dredge basin inlet to minus 4' below
average mean low water, approximately 800 cubic yards, and
use spoil as beach nourishment. Located: Sage Road,
SouthoJd. SCTM#53-5-12.5
TRUSTEE BERGEN: Is there anyone here to speak on behalf of
this application?
MR. COSTEllO: Yes, George Costello, Sr., for the Breezy
Shores Community. We had a verbal from Chuck Hamilton to do
the dredging down at the entrance to the boat basin and to
put it on the beach. The problem is, and I'm sure everybody
is aware, that we have eight jetties, most of them are
nonfunctional due to a lot of facts. One is if you look at
the pictures that I sent you, which were taken about five
months ago, prior to 2001, this community taking ownership,
the in-shore sections of most of those jetties were cut off.
They were cut for the access for kids to play on the beach
because at that time there was quite a bit of beach down
there. The existin9 bulkhead which I bid on and lost the
bid on in 1985 due to my brother's bidding. It's basically
three to four feet out, but the real problem we're going to
face shortly if a Katrina or a Rita ever shows up that the
sheathing to that bulkhead is six feet, there are some areas
where the sheathing is in the bottom two feet. So I tried
to explain this to the DEC that if I did the dredging and
used the material for beach nourishment and was allowed to
put some of the jetties back, I could keep some of the beach
nourishment intact in front of the bulkheads where it's
needed. Otherwise, I'm going to be coming back to the DEC
and the Trustees in Southold looking for a rock revetment to
keep the bulkhead there once the bulkhead is undermined.
Obviously you can see on the eastern end, iI's a little more
prevalent, the beach loss and the erosion that's occurring
on the return. Normally in the past three or four years
we've gotten permission from the DEe to rebuild existing
jetties most of the time, if they were functional, but they
allowed us to cut them back to the low tide and drop the
elevation down to 18". And when you look at these pictu res
thatl presented to the Board, you'll see that most of these
jetties are fairly tall, and that's one of the reasons why
they cut the section out so the kids could play on the beach
