At the meeting of the Southold Town Conservation Advisory Council held Wed., June
.14,2006, the following recommendation was made:
Moved by Jack McGreevy, seconded by James Eckert, it was
RESOLVED to recommend to the South old Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland. Permit application of GREGERSEN'S KEEP, LLC to
construct a 4'X 34' fixed elevated catwalk with steps secured with 6" dia. pilings, 3'X 15'
hinged ramp, and 6'X 20' floating dock secured with 6" dia. pilings.
Located: Gull Pond Lane, Greenport. SCTM#35-3-12.6
The CAC recommends Approval of the application with the Condition there is one
residential dock on the property. The applicant should supply evidence that the existing
docking facility is part of a single separate lot.

Dear President King and Board:
At the public hearing on June 21, 2006 regarding our application
for a dock the Board advised that the Trustees only allow one dock
on a property. I advised you that the existing dock is for the use
and enjoyment of a parcel owned by Mr. Witt, the owner of the 3.5
acres on the west side of Gull Pond Lane. I would point out that
this parcel, before it was subdivided, had two docks (Mr. Witt's and
the southerly lot). These docks were approved by the Trustees and
granted permits. The Trustees recently reviewed the subdivision and
wetland permit for the house and placed no restriction on number of
docks. This would appear to be the only parcel on Gull Pond Lane
which does not have a dock. The attached photograph shows the
waterfront development along Gull Pond Lane. Note that on the east
side of Gull Pond Lane multiple docks exist on a parcel for upland
owners.
The history of the existing right-of-way with a dock on the
above referenced property is as follows:
In 1984 Leon Marcus received approval from the Southold Town
Planning Board for a "Conservation" minor subdivision for a large
open space parcel gifted to Nature Conservancy (Parcel II) and 4
lots: Two 3,5 ~cre landward lots on the west side of Gull Pond Road
(Lot 3 and Lot 4) which lots could not be further subdivided, and two
1 acre waterfront parcels (part of subject parcel). The right of way
was created for the benefit of the 3.5 acre non-waterfront parcels
Lot 3 and Lot 4 of this subdivision. The waterfront lots in this
subdivision did not have use of the riqht-of-wav since the waterfront
parcel were entitled to applv for their own docks. In 1984 Lot 3 and
Lot 4, landward parcels, were purchased from the developer Marcus by
Henry Quintin.
Thereafter, in December 1984 Marcus/Quintin applied to the
Trustees and DEC to construct at the end of the right-of-way a 4' x
60' fixed dock, 3' x 16' ramp, 6' x 20' float with 4 spiles for the
use by Lot 3 and Lot 4 of the upland parcels. Both the Town of
Southold and DEC granted permits to construct the dock for use by the

upland parcels (non-waterfront lots). Neither the Town nor the DEC
imposed a condition on this dock permit that the waterfront lot would
be prohibited from obtaining their own dock permit. In fact in 1989,
Land Use Co., on behalf of Quintin, amended the permit and was
granted a 6' x 10' extension with 6' x 40' "Lff secured by 6" piles
to existing floating dock on right-of-way. This expansion of the
dock and float also received DEC approval (see attached DEC stamped
plan) . At this time two docks existed on the same parcel.
In 2005 Gregersen's Keep LLC subdivided the subject parcel.
This two lot subdivision was approved by all regulatory agencies
(Local and State). The right-of-way and existing dock appears on
this subdivision and the record at all the hearings reflected that
the subdivision was subject to an existing right-of-way and dock
belonged to another. Again, neither the Town nor the DEC restricted
the waterfront lot from having a dock. The owner of the subject
parcel does not have use of the dock, the right-of-way was on record
and the dock was constructed by the upland owner (Quintin, now Beck-
Witt)prior to the Gregersen's Keep subdivision.
There is no recorded restriction on the subject Gregersen's Keep
lot to construct a dock. The application for a dock is in keeping
with the original 1984 subdivision and the existing development along
Gull Pond Lane.
In conclusion, Since 1984 two docks have existed on the
waterfront parcels. The right-of-way was created as part of a
Conservation subdivision, and later shown on the map approved in the
Gregersen's Keep, LLC two lot re-subdivision. The right-of-way and
existing dock at the end of the right-of-way does not benefit the
waterfront parcel. The original subdivision dates back to 1984, as
the Board pointed out, when the Trustees policies to limit the number
of docks on the same parcel was the same as today. The most recent
subdivision of the subject parcel in 2005 and the later development
permits for the houses on these parcels were approved by DEC and
Southold Town Trustees, at no time was there any restriction by any
State or Local agency on prohibiting a dock on the subject parcel.
Such a restriction must be placed on the property when the common
development plan is approved, not 20 years after the right-of-way is
created.

Dear Ms. Moore:
The Planning Board is in receipt of your letter dated August 7, 2006 requesting that the
right-of-way that provides access to the exiting dock be separated from the property in
exchange for the same square footage on the north-west side of the parcel.
The Board discussed this matter at their work session on August 21,2006 and determined
that they cannot process your request as proposed. There are no provisions in the Code
which allow the Planning Board to create an undersized lot for the sole purpose of providing
access to the water or to allow a property owner to construct a second dock. This is a
Trustee matter and cannot be resolved by Planning Board action.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
L WRP provided that:
I. If feasible. the installation of a silt boom/turbidity screen durin!! construction
activities is reauired to minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for permits. including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building
Permits and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered ltyes", then the proposed action may affect
the achievement of the L WRP policy standards and conditions contained in the consistency review
law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making
a determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.
