a. ~n MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
\!. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF OCTOBER 27, 2005

Property Location: 10435 Peconic Bay Boulevard, Mattituck CTM 144-1-24
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 4,158 sq. ft. parcel has 42.97 feet along the
north side of Peconic Bay Boulevard and lot depth of 96.55 feet. The property is improved with a
single-story, one-family dwelling and detached storage shed, as shown on the April 28, 2005 land
survey prepared by Hands on Surveying.
BASIS OF APPLICATION: Building Department's July 5, 2005 Notice of Disapproval, amended
August 11, 2005, citing Sections 100-242A and 100-244 in its denial of an application for a building
permit for the reason that the proposed addition will increase the degree of nonconformance when
located at less than a single side yard of 10 feet, less than 25 feet total side yards, and building
coverage greater than the code limitation of 20% of the lot size.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on October 20, 2005 at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
i1 AREA VARIAN E R LIEF REQUESTED: The applicants wish to construct a 25.4' x 15' one-story
addition at the f their existing dwelling with side yard setbacks at 7.5 feet (on the west side)
and 10.2 feet "(on the east side), and lot coverage at 26,94%.
(JP REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant proposes to increase the total side
yards and the westerly single side yard for a new porch addition. The side yard setbacks are

proposed at 7.5 feet and 10.2 feet, which is an increase in the setback from the present
nonconformity for the dwelling, which nonconformity is only 2.4 feet on the west side. The total
combined side yards for the new construction will be 17.7 feet, also an increase from the present
nonconformity, which is only 12.6 feet for the combined side yards at the closest points.
2. The proposed one-story addition, while it will increase the total lot coverage to 26.94 per cent, is
entirely on the side of the house, farthest from a lot line (with the greatest yard area), and the
setback will exceed the front setback requirement ofthe code with a proposed 50.3 feet from the
front property line,
3. The relief sought is not substantial. The relief is limited to a modestly sized one-story addition in
place of an existing deck and patio.
4. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
5. Grant of the requested relief is the minimum action necessary and ad\lquate to enable the
applicant to enjoy the benefit of a porch addition, while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member
Goehringer, and duly carried, to
GRANT the variances as applied for, as shown on the diagrams S-1 and 8-2 prepared by
Condon Engineering, P.C. and the April 28, 2005 survey prepared by Hands On Surveying.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, and Simon. (Member
Orlando was absent.) This ResolutioaS duly adopted (4-0). .
