WITNESSETH,that the party of the first part, in consideration of

by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,

In the Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the westerly line of a certain proposed road (which point
is the southeasterly corner of the premises herein described and the northeasterly
corner of premises heretofore conveyed to John A. Gagen by deed dated January 28,.
1957, and recorded in the Suffolk County Clerk's Office on February 4, 1957, in
Liber 4253 of deeds at page 440) (and which point is North 2 degrees 01 minutes
50 seconds west a distance of 120.59 feet from the intersection formed by the
! northerly line of Clearview Avenue with the westerly line of the aforesaid proposed
road); running thence in a westerly direction along said land of John.A. Gagen,
North 85 degrees 15 minutes o0 seconds west a distance of 156.01 feet; running
thence North 1 degree 28 minutes 10 seconds East a distance of 75; running thence
in an easterly direction along other land of the party of the first part a distance
of 150 feet, more or less, to the eastely line of the aforesaid proposed road at
a point vhlch is North 2 degrees 01 minute 50 seconds west a distance of 100.0
feet from the point or place of beginning; running thence along said proposed road
South 2 degrees 01 minute 50 seconds Bast a distance of 100.0 feet to the point or
j place of beginning.TOGETHER with the right to the use of a right of way in common
with others over saidd pro sed highway from the northeasterly corner of the premises !I

1. That every dwelling house erected on said premises shall cost not less than

dedicate said private road to the Town of Southold as a public highway, and the
part y of the second part, by the acceptance of this deed, does hereby consent to
such dedication and does hereby release the said Town of Southold from any liability
for damages by reason of said dedication of said private road as a public highway.
