WITNESSETH, that the party of thc first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, thc hcirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, sima~, lying
andbeinginthe Hamlet of Peconic, Town of Southold, County of Suffolk and State of
New York, bounded and deacribed ~s follows:
BEGINNING at a point on the southerly line of North Road (C.R. 49) at the
northwesterly corner of land of Cornell, being the northeasterly corner of the
premises herein described;
RUNNING THENCE along said land of Cornell, South 23 degrees 51 minutes
20 seconds East, 198.30 feet to the land of Suffolk County;
THENCE along said land of Suffolk County, 58 degrees 07 minutes 20 seconds
West, 200.00 feet to land now or formerly of Hass;
THENCE along said land North 23 degrees 53 minutes 30 seconds West, 199.B0
feet to the southerly line of North Road;
THENCE easterly along said southerly line on a curve to the left having ~
radius of 5789.58 feet a distance along said curve of 200.00 feet to the point of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the grantor herein
by Deed dated 02/11/77, recorded 02/18/77 in Liber 8194 cp 67 and deed dated
01/11/82, recorded 01/20/82 in Liber 9134 cp 350.
SUBJECT to a Purchase Money Mortgage in the sum of $225,000.00 of even date hereof
made between the party of the second as Mortgagor and the party of the first Part
as Mortgagee to secure the balance of the purchase price of $318,000.00
TOGETHER with all right, title and interest, if any, of the party of thc first part of, in and to any slroets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party oft. he second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first pat'ti in compliance w/th Section 13 of the Lien Law, covenants that the party of the
first part w/Il receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be cons~'ued as if it read "parties" whenever the sense of this indenture so requires.
