Minutes of Regular Meeting held

Both properties are for sale. LPC members find farm parcel, purchase of development rights, of more
interest. Need further information from landowners as to their intentions regarding the property.

Melissa Spiro gave overview of entire project bringing all LPC members up-to-state of status of
project. Both County and Town have had appraisals prepared. Project proposed as 50/50 partnership
with Town/County.
Randy Parsons of The Nature Conservancy gave presentation of this significant, intact
environmentally sensitive area, remaining on Long Island Sound and County’s position on partnering
with Town for its purchase. There is the potential for federal grant money available providing an
extension of an existing grant award is extended. Randy and Melissa are working on this extension.
Melissa has requested an executive session appointment with the Town Board at their next work

session on March 13 and requested that all available members attend to promote this project in her
absence.
MOTION
made by Lillian Ball, seconded by John Sepenoski, to make a presentation of this project to
the Town Board at their work session on Tuesday, March 13, 2007, to allow Randy Parsons of The
Nature Conservancy to proceed with purchase negotiations with the landowner based upon the
County’s ETRB determination of a purchase price, with a 50/50 partnership with the County of Suffolk
and the potential of the Town receiving a $1.5 million federal grant towards this purchase.

Reviewed inquiry re: Subdivision Open Space parcel in pending subdivision.
This standard subdivision is currently under Planning Board review. Landowners have offered to gift
the subdivision open space to the Town of Southold. Melissa to keep LPC members apprised of
status of subdivision.

Property for sale – inquiry re: preservation.
Melissa met with a potential buyer who is interested in preserving a major portion of this property if
the Town will allow for an office along the Main Road and a buildable residential area preferably in the
center of the lot. He has offered a potential purchase price for the easement.
LPC members consider this project of low priority and would more likely give further consideration to
this project if the potential buyer would offer the easement to the Town as a bargain sale. LPC
members have directed Melissa Spiro to contact the potential buyer and see if his interest remains if
an appraisal of this property does not support his purchase price per acre expectations for the
easement area.

East Coast Residential Properties – inquiry from potential purchaser of development rights

Potential purchaser raised several questions in e-mail concerning potential use of the property for
nursery tree stock, Christmas trees, and the sale of U-pick trees. In response to questions raised,
LPC members agreed that a barn or storage building could be constructed on the property provided it
housed only equipment relating to the nursery, not landscaping equipment or such. Deer fencing
would be allowed with LPC review and approval. No farmstand for retailing. Would allow for selling
nursery tree stock produced on the property but not for selling any imported cut trees. Melissa to
contact potential purchaser with LPC’s responses.

Question from Lisa Kombrink, Esq. re: LPC’s revision re: allowance for subdivision of PDR
easement area.
LPC had previously requested that Lisa Kombrink, Esq. revise LPC “template” easement to allow for
subdivision of PDR land so long as such subdivision did not result in parcels less than 10 acres. Lisa
requested additional information as to whether or not such 10 acre parcel must be all preserved land.
LPC members made a decision to allow for the subdivision of PDR land provided that the resulting
farm parcel would each result in an area of 10 or more acres of preserved land.

Board of Ethics Determination re: Sepenoski
John Sepenoski reported that the Board of Ethics determination regarding his disclosure of a family
relationship to a potential LPC applicant would not create a conflict of interest provided he recuse
himself from all discussions and decisions based on the family related applicant.

Land Preservation Seminar – March 8, 2007 – 8:30 a.m. to 2:30 p.m.
LPC members requested to attend if available. John, Chris and Lillian plan to attend.
