ALL that certain plot,piece or parcel of land, 5{ situate

BEGINNING at a point on the southerly side of Midfarm Road a private
56 foot road where the northeasterly corner of the land about to be
described intersects the northwesterly side of land of John and
Lillian Frees;
RUNNING TRENCH along said land now or formerly of John and Lillian
Frans, the following two coursos and distances:
(1) South 1 degree 15 minutes 10 seconds east 130.0 foot;
(2) South 34 degrees 19 minutes west 165.0 feet to the northerly side
of Youngs Road West, a private road;
TAENCE north 55 doroes 41 minutes west along the northerly side of
Youngs Road wort 168.83 feet;
THENCE north 28 degrees 05 minutes 10 seconds east 190-45 feet to
the southerly side of Midfarm Road;

southerly side of Midfarm Road 140.0 feet to the point or place Of
beginning.
TOGETHER with the right to the use of a right of way (in common with
others) over said "Harper Road" from the southerly corner of the
premises northeasterly about 500 foot to said "Youngs Road East".
ALSO with the right to the use of a right of way (in common with
others) over said "Youngs Road West" from the westerly corner of the
promises southeasterly about 3116 foot to said "Harper Road".
ALSO with the right to the use of a right of way (in co®on with
others) over said "Midfarm Road" from the northwesterly corner of the
promises easterly and then' southeasterly about 415 foot to said "Harper
Road".

ALSO with the right to the use of a right of way (in common with others)
over said "Youngs Road East" from said "Harper Road" northwesterly
and then northerly about 1550 feet to the southerly end of Youngs
Avenue.
EXCEPTING AND RESERVING to the parties of the first part, their dis-
tributeos, assigns, nominees or licensees, the right and privilege to
enter upon the property herein described and lay, construct, erect
and maintain therein or thoreon sewer pipes, water or gas mains,
telephone light poles, wires and conduits, with all ordinary appurtan-
mesa and fittings; provided, however, that sewers, pipes, mains,
poles or conduits shall be laid, constructed or erected only within
five (5) foot of the right of way Sines of the said property in such j
Instance.
SUBJECT TO THE FOLLOWING COVENANTS AND RESTRICTIONS:
1. That said premises shall be used exclusively for residential pur-
poses only.
2. That the construction and erection of buildings on the promises is
limited to two one-family residences only of conventional type; two
private garages with servants quarters constructed or erected in
connection with the garages.
3. All sewage arising from the use and occupancy of the promises shall
be disposed of in cesspools or in septic tanks and no outside toilets.

4. No $Owego or refuse of any kind shall be permitted to empty into
the adjacent waters and the grantee herein agrees to keep said water
and the land bordering on said waters in front of the above describe
premises free and safe therefrom and free from other debris.
5. No horses, cows, cattle, goats, hogs, poultry or ducks shall be
kept or raised on said promises nor shall any use be made of said
premises which is offensive, unsightly, unhealthy or tonding to
damage in any manor the adjoining property or to disturb the peace
Of the inhabitants of the neighborhood.
6. That each dwelling house erected on said promises shall contain
not less than 1500 square feet on the ground floor.
ALL or any of the above covenants and restrictions may be modified,
altered or annulled as to the premises described or as to any other
neighboring property now or formerly owned by the parties of the first
part at any time by written agreement by and between the grantors,
their distributoes,or assigns, and the then owners for the time being
of the promises upon which it is agreed to amend, alter or annul such
covenants and restrictions as to said premises without the consent of
the owner or owners of any adjhcent premises or any neighboring premi-
ses, now or formerly owned by the parties of the first part, or any
other party or mortgagee holding any interest in the said promises.
The foregoing covenants and restrictions shall be deemod real covenants
running with the land and be binding upon the succossors, assigns,
distributeos, legal representatives, executors or administrators of
the respective parties hereto until the first day of January, 1980,
when they shall cease and terminate.
It is the int action of the parties of the first part to grant certain
rights of access to water to the purchasers of portions of real
property not fronting on the water. The parties of the first part
agree that the parties of the second part shall be entitled to the
samo rights and privileges that may hereafter be granted to subsequent
purchasers of inland property.
The grantors herein are the same persons as the grantees in the Deed
dated March t, 1939 which said deed was recorded in the Suffolk
County Clerk's office in Liber 2015 of Deeds at Page 56 on March 3,
1959.
