Van Tuyl & Son, Licensed Surveyors, Greenport, N. Y„ and filed in the Office of the Clerk of Suffolk County on the 22nd day of January, 1959, as Map No. 2910, being approximately 125 feet square. TOGETHER with a right of way over "Bay Haven Lane," 'Watersedge Way," "Gin Lane" and I'I4id Way,If as shown on said map,_ and the right, in common with other owners of the lots shown on said map to the use of the "Community Beach" as designated on said map. SUBJECT to the provisions of the declaration recorded by the seller on February 10, 1959, in the Suffolk County Clerk's Office in Liber 4585 at page 346. RESERVING NEVERTHELESS unto the grantor, his heirs, ad- ministrators, executors and assigns, the feb to the said "Bay Haven 'Lane," "Watersedge Way," "Gin Lane" and "Mid Way", and to the "Com- munity Beach" and all franchise rights therein and the right of dedi- cation of said streets and community beach to a Property Owners' Assoc- iation which may hereafter be organized. NOTWITHSTANDING anything to the contrary herein contain- ed, FURTHER RESERVING unto the grantor, his, heirs, administrators, executors and assigns, an easement over the said "Gin Lane" and i "Watersedge Way" and the westerly 25 feet of Lot number 56, for the benefit of land of William C. Mayer'and M. D. Dickerson for the pur- ^ose of ingress and egress to and from said premises and to and from: Ithe public highway known as Main Bay View Road, which said easement may be granted or withheld at the option of the grantor. THE PARTY OF THE FIRST PART covenants that he will not convey or dispose of any lot in the said Bay Haven at Southold except by deed containing restrictive covenants substantially equivalent to the covenants herein contained. I� ueEa5173 PAGE259 THE PARTY OF THE SECOND PART agrees for himself, ,hie. heirs, executors, administrators and assigns, that he will join a, Property Owners' Association hereafter to be formed for the purpose v of maintaining the said streets and said community beach as shown on said man of Bay Haven at Southold, and for such other purposes as may from time,to time be determined by such Property Ownerst Association, and thathe will abide by the rules and regulations of said associa- tion as set forth in the by-laws thereof, and that upon the formation of said Property Owners' Association the property herein conveyed shall be subject to an annual charge, not to exceed fifty dollars,; which said sum shall be payable annually in advance on a date to be fixed by said Property Owners' Association, and that such charge or assessment shall become a lien upon the land and so continue until fully paid, and he does hereby authorize and empower the said Pro- _ perty Owners' Association to bring any and all actions or legal pro- ceedings in its name for the.collection of such charges or assessments land the enforcements of such liens, and that this coven shall rvn with the land and-bind all future owners thereof. The conveyance hereunder is subject to a certain mortgage l executed by WILLIAM WELLS as mortgagor to the SOUTHOLD SAVINGS SANK as mortgagee, which mortgage is dated February 3, 1961, andwasre- corded on February 7, 1961, in the Office of the Clerk of the County of Suffolk, in liber 3574 of mortgages, at page 465, and on which mortgage there is now due the sum of $12,828.15, with interest thereon at the rate of 6 per cent per annum from May 3, 1962, and that the (grantee hereby assumes and covenants to pay such mortgage debt and interest as part of the consideration for this conveyance.
