Koke' on the west side thereof from land of F. Koke on the east side thereof, said monument being distant the three following courses and distanc es as measured along the northeasterly, easterly and northerly sides of Calves Neck Road from the southerly terminus of tho town highway known as YoungJ Avenue, to wit: (1) South 55 degrees 00 minutes East 302.67 feet; {2} South 16 degroes 11 minutes 20 seconds East 224.77 fept and (3) South 74 degrees 21 minutes 20 seconds East 260 feet; running thence from said pipe at the point or place of beginning South 74 degrees 21 minutes 20 seconds East along tho southerly side of Calves Neck Road 200 feet to land now or formerly of Bartlett; running thence along said land last mentioned (11 South 19 degrees 27 minutes 30 seconds West 1$0.33 feet to a pipe in land now or formerly of L. B. Hill; running thence the two following courses and distances, along said land last mentioned being the southerly and westerly boundaries respectively of the heroin described premises, to wit: {l} North 74 degrees 21.minutes 20 seconds ~{est 190 feet to a pipe and (2) North 1$ degrees 39 minutes 40 seconds East 1$0 feet to the pipe at the point or place of BEGINNING. .==-,.-: Being and intended to be the same premises conveyed by L. Barron Hill and Adelaide H. Hill, .his wife, to Ralph C. Fish and Diana V. Fish, his wife, by deed dated July 30, 1959 and recorded in the Suffolk County Clerkl s Office on August 14, 1959 in Libel" 4675 of Deeds at page 490, together with all the rights and privileges therein contained and subject to the covenants and reservations therein set forth. TOGETHER wi th such right of' access to water which the parties of the first part have, if any, and which was granted in the deed to them by L. Barron Hill and Adelaido H. Hill, his wife, dated July 30, 1959 recorded August 14, 1959 in Libel' 4675 cp 490. us 85442 PAGE 22 TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGE'J?1ER with the appurtenances and all the estate and rights of the party of tbe first part in and to said premises. ~O HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the sel;ond part forever. ~UBJECT to a mortgage held ~ Soutbold Savings Bank in the amount of ~20,OOO.OO. now reduced to ~b,oOO.OO (Libel' 3331 mp 112), the payment of which mortgage 1s hereby assumed by the parties of the socond part and the said parties are executing. and acknowledging this instrument for tho sole purpose of evidencing the aSBumption of and agreement to pay the aforesaid mortgage indebtedness of ~-6,OOO.OO. I II ~ 1\ 'I I I AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. l AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this wnveyance and will hold, the right to receive suw consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
