ALL that tract or parcel of land, situate, lying and being at
Bay View, near Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:-
BEGINNING at a point on the easterly line of a 50 foot private road
known as "Summit Road", 280.0 foot northerly along said easterly line
from the northerly line of a 50 foot private road known as Ed's Road";
said oasterly'lino of "Summit Road" boing parallel to and 400 feet
westerly from the westerly boundary line (or its extension southerly) of
lend of Frank Stelzer, and said northerly line being parallel to and
382 feet northerly from the northerly line of Frain Bayview Road,
moasured at right angles thereto; said point of beginning being the
northwesterly corner of land of 'Worth; from said point of beginning
running alon� said easterly line of said 50 foot private road known as
"Summit Road , North 28 degrees 41 minutes 30 seconds East, a distance
of 130.0 feet; thence along ]and of Edward Nidds, 2 courses, as follows:
1) South 60 degrees 02 minutes 40 seconds East, a distance of 125.0
foot; thence
2) South 28 degrees 41 minutes 30 seconds blost, a distance of 130.0
foot to said land of Worth; thence along said land of 'rlurth, North 60
dogrees 02 minutes 40 seconds ',Jest, a distance of 125.0 foot to the
point of beginning.
TOGETHER with a right of way over said 50 foot private road known as
"StvmBit Road" from the northwesterly corner of the promises southerly
to said 50 foot private road known as "Ed's Road", and thence westerly
over said "Ed's Road" to a 50 foot private road known as "Victoria
Drive", and thence southerly over said "Victoria Drive" to Main
Bayviow Road.
TOGETHER with the right to the use, in common with others, of a
strip of land 50 feet in width as an casement to Corey Creek, said
strip of land being bounded on the oast by land of 3dson and on the
wost by land of Toedtor and Dickinson.
SUBJECT to any state of facts an accurate survey may show, provided
the same does not render the title thereto unmarketable.
SUBJECT to any state of facts an inspection of thosEP5569 promises
disclose. The purchasers represent that they have inspected said
i promises and are purchasing same "AS IS".
SUBJECT TO THE FOLLOWING COVENANTS AND RESTRICTIONS:
1. No more then one dwelling house shall be erected on said premises.
2. Any dwelling house erected on said promises shall cost not less than
o8,5oo.00
3. Said covenants and restrictions shall expire on January 1, 1975•
Being and intended to be the same promises conveyed by Edward Nidds
to George Howell Nanning and Josephine K. Nanning, his wife, as tenants
by the entirety, by doed dated January 21, 1961 and recorded in the
Suffolk County Clerk's Office on January 26, 1961 in.Libor 4940 of Deeds
at pago 67, and subject to the reservation therein contained reserving
the right of Edward Nidds to dedicate the private roads to the Town of
Southold as public highways, the said George Howell Nonning having died
a resident of Nassau County on May 22, 1963 survived byhiswife,
Josephine K. Nanning, the grantor herein.
The aforesaid easement to Corey Creek being more particularly
bounded and described as follows:
Beginning at a point marked by an iron
pipe on the southerly line of Bayviow Road, distant 30 feet easterly
along the said southerly line from the point where the said southerly
line is intersected by the direct extension southerly of the boundary
line be04een land now or formerly of Edward Nidda and land now or
formerly of Edson, said point of beginning being the northwesterly
corner of other land of Edson; and from said point of beginning, running
along said land of Edson the following courses: (1) South 29 degrees
57 minutes 20 seconds West a distance of 300 feet; thence (2) south 35
degrees 10 minute! 10 seconds West a distance of 970 feet, more or less,
to Corey Creek, The Westerly line of the said easement or right of way
being parallel to and 50 feet westerly from the above described easterly
line measuaed at right angles thereto.
