WHEREAS, pursuant to the provisions of.the Suffolk County Improvement .Act the
above entitled proceeding was duly instituted by an Order of the Supreme Court which was
duly filed in the Office of the County Clerk of Suffolk County on the 18thday of
February , 1965 , and that thereupon title in fee simple to the property to be
acquired in said proceeding became vested in the County of Suffolk, New York, and the
proceeding continued for the purpose of determining the compensation to be made to the
owners of the real property to be acquired in this proceeding is to be ascertained by the
Court without a jury, and
WHEREAS immediately prior to the vesting of title as aforesaid in the said County of
Suffolk

awned the parcel of property acquired as aforesaid and designated in said proceeding
as Map No.Parcel XWwhich mid parcel of property is more particularly described as
follows:
ALL that piece or parcel of land situate in the Town of Southold,
County of Suffolk, State of New York, for County Purposes, and described
as follows:
BEGINNING at a point on the existing. southerly boundary of Sunrise
'Nay, a private road, at its intersection with the division line between the lauds
Of an Unknown Owner on the east and sub-division Lot No. 165 of a hereinafter
described sub-division on the west; thence S 210 14' 40"E, along the said division
line, Z16.63 feet to its intersection with the division line between sub-division
Lot No. 167 on the east and the lands of an Unknown Owner on the west; thence
N 300 45' ZO" E, along the last mentioned division line 25.38 feet to its intersection
with the division line between sub-division Lot No. 168 on the east and the lands
of an Unknown Owner-on the west; thence N 210 14' 40" W, along the last mentioned
division line, 135.0 feet to its intersection with the division line between sub-
division Lot No. 169 on the north and sub-division Lot No. 168 on the south;
thence S 610 54' '10" E, along the last mentioned division line, 139.0 feet tothe -_
westerly boundary of a dredged canal, Unknown Owner; thence along the last
mentioned boundary the following two (2) courses and distances: (1) S 010 OZ' 40" E
105.39 feet; and (2) S 030 12' 30" E, 175.51 feet to a point; thence S 860 47' 30" W,
still along the boundary of said dredged canal, 60.00 feet to the average high water
line of Cedar Beach Harbor as shown on a sub-division map entitled "Map of
Cedar Beach Park", and filed in the office of the Clerk of Suffolk County on
December 20, 1927 under File No. 90; thence along the said average high water
line the following two (2) courses and distances: (1) N 320 49' 30" W, 15Z.17 feet;
and (2) N 480'18' 40" W, 198.35 feet to its intersection with the division line
between sub-division Lot No. 165 on the east and sub-division Lot No. 164 on
the west; thence N 300 45' 20" E, along the last mentioned division line, 164.00
-feet to a point on the first mentioned southerly boundary of Sunrise Way; thence
easterly along the said southerly boundary on a curve deflecting to the left,
having a radius of 92.0 feet, an arc distance of 30.0 feet to the point of beginning;
being all of Lots Nos. 165, 166, 167 and 168 as shown on the first mentioned
sub-division map of "Cedar Beach Park", being 1.337 acres, more or less as
shown on a map on file in the office of the Commissioner of Public Works of
Suffolk County.

wand WHEREAS, the said person or persons who owned said parcel of property
prior to its acquisition as aforesaid by the County of Suffolk desire to compromise
and settle the claim for compensation therefor at the sum of$22v000.00 , which
the said County agreed to pay,
NOW, THEREFORE, in consideration of the premises and of the sum
of$ 22.000.00, lawful money of the United States, in hand paid to the under-
signed, receipt whereof is hereby acknowledged, the undersigned hereby accepts
said sum in full compromise and settlement of any and all claims for compensation
or damage by reason of the acquisition of said parcel of property by said County,
and the ascertainment of compensation or damages by the said Court is hereby
waived and the said County of Suffolk is hereby released from any other or further
claim for the acquisition of said parcel of property, and the undersigned hereby
ratify and confirm the title to said parcel of property acquired by said County
as aforesaid.
As an inducement to said compromise and settlement it is represented and r
guaranteed by the undersigned that at the time title to said parcel of property
vested in said County the undersigned had fee simple title thereto free of any
incumbrances or liens or claims of any nature and that no assignment has been
made of the compensation to be paid by said County for said property.
