ALL those certain lots, pieces or parcels of land, with
buildings and improvements thereon erected, situate, lying and being
at Bay View, near Southold, in the Town of Southold, County of Suffolk,
and State of New York, being known and designated as Lots Numbered 97,
98 and 99 on a certain map entitled, "Map of Goose Neck, situate at Bay
View, Town of Southold, County of Suffolk, New York, owned by G.W. Smith
& Sons", made by Otto W. Van Tuyl, Licensed Surveyor, Greenport, New
York, and filed in the Suffolk County Clerk's Office on November 229
1948, as and by File #1663.
BEING AND INTENDED TO BE the same premises heretofore con-
veyed by Charles T. Bennett and Ruth B. Bennett, his wife, by deed dated
June 20, 1959, and filed in the Suffolk County Registrar's Office on
June 23, 1959, under Land Title Registration Certificate No. 43385•
TOGETHER with the right to use, for all reasonable pur-
poses, in common with others, subject to such reasonable rules and reg-
ulations with respect to the use thereof as George W. Smith & Sons, Inc.
may from time to time put into effect, that portion of Lots No. 37 and
/ 38 and part of lot 39 on said map, known as the beach property, it being
the intention to grant to the party of
