THIS INDENTURE,made the day of May ,nineteen hundred and Sixty four
BETWEEN GENEVIEVE T. DALY, individually and as Executrix of the
Estate of THOMAS F. DALY, JR., late of the County of Westchester,
residing at 527 Highbrook Avenue Pelham Manor, New York, and
KATHRYN D. HOEY, residing at 2121 Albemarly Terrace, Brooklyn,
New York,
party of the first part,and JOHN R. ADLER and ANITA K. ADLER, his wife,
residing at 52 Perry Lane, Hazardville, Connecticut,
party of the second part,
WITNESSETH,that the party of the first part.in consideration of

lawful money of the United States, and other valuable consideration paid
by the party of the second part,does hereby grant and release onto the party of the second part,the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with Elie beildingramFm,prwvemm-Lfieremttreeted, situate,
lying and being in-the at Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the northerly side of a 30 foot right of way
distant 140.0 feet easterly from the intersection of the northerly
side of said 30 foot right of way with the easterly side of Town
Harbor Lane and which said point of beginning is the southeast
corner of land now or formerly of E. J. Donlon; running
thence north 41 degrees 07 minutes 30 seconds west along said land
now or formerly of E. J. Donlon 102.66 feet;
thence north 33 degrees 01 minutes 50 seconds west 57.91 feet;
-f thence north 52 degrees 48 minutes 10 seconds east 118.69 feet;
thence south 40 degrees 19 minutes 10 seconds east 142.65 feet to
the northerly side of said 30 foot right of way;
thence westerly along the northerly side of said 30 foot right of
way on the arc of a curve bearing to the right having a radius of
941.29 feet a distance of 125.00 feet to the point or placeof
beginning.
TOGETHER with an easement for ingress and egress to and from Town
Harbor Lane over said 30 foot right of way.
SUBJECT to the following restrictions:
1. That only one single family dwelling house for private residential
purposes and a private garage for family use, shall be built upon the
lot as aforesaid described. Trailers, tents or camping shall not be
permitted. Occupancy of any such dwelling house shall not be permitted
until the outside walls and roof shall be fully and completely finished:
2. That no building, structure or structures on, above or below the
surface of the land, other than public utility pipes or lines shall be
erected, constructed or maintained, which shall be in violation of the
zoning regulations approved and adopted by the appropriate agencies,
authorized to issue such regulations.
