West, a distance of.110.0 feet along said southwesterly line from a monu-
ment at the northerly corner of land of Fraas; from said point of begin-
ning running along land of the party of the first part, South 21 degrees
52 minutes 00 seconds 'Jest, a distance of 257 feet, more or loss, to th6
northeasterly edge of a dredged canal; thence northwestbrly along said
canal and along the center line of the old gutter being partly along land
of G. H. -,Jells Estate, about 750 foot; thence along said land of G. H.
Wells Estate, North 30 degrees 04 minutes 30 seconds West, a distance of
261.18 feet to the northeasterly line of Wells Avenue; thence along said
northeasterly line, North 30 degrees 04 minutes 30 seconds West, a dis-
tance of 58.45 feet; thence along said land of the party'of the first part

the westerly line of said proposed highway known as "Hill Road"; thence
along said westerly line, South 19 degrees 26 minutes 00 seconds West, a
distance of 52.67 feet to said southwesterly line of said highway; thence

utes 50 seconds East, a distance of 487.81 feet; thence (2) South 55 de-

ALL that certain plot, piece or parcel of land, situate, lying and
being at Southold, in the Town of Southold, County of Suffolk and State,
of New York, bounded and described as followa:-
BEGINNING at a monument on the southerly line of a proposed highway
to'be known as "Midfarm Road" at the northwesterly corner of land of
Filardi; from said point of beginning running along said land of Filardi,
South 21 degrees 06 minutes 10 seconds West, a distance of 185.0 Poet to
a monument on the northerly line of a proposed highwayy to be known as .
"Hill Road"; thence along said northerly line, North 68 degrees 53 minute=

westerly on a curve to the right having a radius of 102.95 foot, a dis-
tance of 158.71 feat to an iron pipe on the easterly lino of "hill road";
thence along said easterly line, North 19 degrees 26 minutes 00 seconds
East, a distance of 84.03 foot to an iron pipe; thence northeasterly on a
curve to the right having a radius of 29.43 foot, a distance of 62.01 foot
( to an iron pipe on said southerly line of Midfarm Road"; thence along
said southerly line, two courses: (1) easterly on a curve to the left
having a radius of 192.89 foot, a distance of 85.0 feet to an iron pipe;
thence (2) South 65 degrees 05 minutes 00 seconds .;act, a distance of
26.02 feet to the point of beginning.
TOGETHER with a right of way over said proposed highways to be known
as "Midfarm Road" and "Hill Road" from the promises to Calves Idock Head.
PARCEL THREE:
ALL that certain plot, piece or parcel of land, situate, lying and
being at Southold, in the Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:-
BEGINNING at a monument on the northerly lino of a proposed highway
to be known as "Midfarm Road" at the easterly end of a curve connecting
said norther IT line to the easterly line of a proposed highway to be known
as "Hill Road'; said point of beginning being the southeasterly corner of
land of DeMott; from said point of beginning running along said land of
DeMott, North 35 degrees 09 minutes 40 seconds East, a distance of 148.71
feet to a monumant and land of Fish; thence along said land of Fish, South
74 degrees 21 minutes 20 seconds Fast, a distance of 190.0 foot to an
iron pipe; thence along land of Bartlett, South 73 degrees 36 minutes 50
seconds East, a distance of 190.0 feet to an iron pipe and land of Barnes;
thence along said land of Barnes, South 12 degrees 01 minute 00 seconds
West; a distance of 135.96 foot to said northerly line of "Midfarm Road";
thence along said northerly line, throe courses: (1) South 68 degrees 44
minutes 50 seconds 'West, a distance of 118.20 feet; thence (2) westerly
on a curve to the right having a radius of 200.0 foot, a distance of 91.35
foot; thence (3) North 65 degrees 05 minutes 00 seconds ',Jest, a distance
of 237.94 feat to the point of beginning.
TOGETHER with a right of way over said proposed highways known as
"Midfarm Road" and "Hill Road" from the promises to Calves Hock load.
Parcels Two and Three and each plot portion of Parcel One shall be
subject to the following covenants and restrictions:
1. That said promises shall be used exclusively for residential purposes
only.
2. That the construction and erection of buildings on the promisos is
limited to one ono-family residence only of conventional typo; one private
garage with servants quarters constructed or erected in connection with
the garage.
3. All sewage arising from the use and occupancy of the promises shall be
disposed of in cesspools or in septic tanks and no outside toilets shall
be erected or maintained.
4. No sewage or refuse of any kind shall be permitted to empty into the
adjacent waters and the grantees herein agree to keep said waters and the
land bordering on said waters in front of the above described promises
free and safe therefrom and frog from other debris.
5. No horses, cows, cattle, goats, hogs, poultry or ducks shall be kept
or raised on said promises nor shall any use be made of said premises
which is offensive, unsightly, unhealthy or tending to damage in any man-
nor the adjoining property or to disturb the peace of the inhabitants of
the neighborhood.
6. That said dwelling house erected on said premises shall contain not
les8 than 1500 square feetanthe ground floor, unless plans and speci-
fications of a dwelling house of a smaller size are approved in writing
by the parties of the first part or their designee. Prior to construction
of any building, the plans and specifications shall be submitted to the
parties of the first part for written approval and no construction shall
be commenced until such writt on approval has bean granted. Such approval
shall not be unreasonably withhold.
All or any of the above covenants and restrictions may be modified,
altered or annulled as to the promises described herein or as to any other
neighboring property now or formerly owned by the parties of the first
part at any time by written agreement by and between the grantors, their
distributees or assigns, and the then owners for the time being of the
promises upon which it is agreed to amend, alter or annul such covenants
and restrictions and such agreement shall be effectual to modify, alter a
